Currently both of us are very sad as the embassy is asking for some document that is impossible to obtain. Local Law does not allow it. Does anyone know if I can appeal or ask the embassy to review the case again. Appreciate any help and advice that I can get. Sad for me as it my fault for not being able to be with her during the interview.

If our K1 get rejected during the interview because of documentation 221(g), when can we re-file a new K1 application. Thanks for the advice.

What paper is it and I would call and ask them if it is impossible to obtain then how can I go about this..Also maybe have your SO find out from the court house if there is something that she can use for the visa that is obtainable

07/17/08 Arrived and picked up by CSC

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Is this a white slip indicating the case is being sent back to USCIS or a blue slip asking for specific document(s)? Generally, giving up and re-filing is not the best option.

What does th 221(g) paper say, in detail?

Yes, that's good general information but to help this poster, we need to know what was requested. Perhaps it's not impossible to obtain what is requested. If it is indeed impossible in this situation but not others, refiling won't help because the same document will be asked for again. Without details we really can't be of much assistance. Please leave the names out of the details.

Thank you everyone for the good information. Currently I am working with Singapore agency to see if I can obtain the document.

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

Like what pushbrk said, is that a white slip or blue slip? I'm going to have my interview on 30 Jan 2009 in Singapore too, I would like to know what kind of document that was impossible for you to obtain but was required so.

Is she Singaporean? Is it a must for you to be there during the interview? :huh:

Is it a must for you to be there during the interview?
Some embassies will never tell you this. Question to ponder: Do you want to be on the consular premises, and (details of the interview aside) thus increase the odds of the visa being approved?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

As suggested above, it's very important to know exactly what the document she was given says.

Secondly, it's just as important to do everything in your power to keep the file at the Embassy and not let them return it to uscis. You may need to hire an attorney familiar with this Embassy to help you with this.

Filing a new petition is not going to solve the problem.

She is not a Singaporean and her case is unique. If you are a Singaporean , I believe you do not have any issue.
