My I-751 was sent out and the NOA just came in (though the waiting period was longer than usual), in between we've found out that she gets pregnant, should we submit proof of her pregancy as an additional evidence to be more supportive? Does this do any good?

Actually, while it would be nice to include it I doubt there is any way to match up the information with the application at this stage of the game. If you get an RFE then you could send it in at that time. The information is not going to speed up the processing one way or another and I strongly suspect two documents sent in at different times will never meet up at USCIS unless USCIS initiates the process. Congratulations on the pregnancy, and good luck with the I-751.

Congratulations on your wife's pregnancy, and hope all goes well there for you, her, the baby, and your family.

By the way, if you don't mind me asking, when is your wife due?

In answer to your question, likewise, I'm in the same situation too, as I found out I was pregnant after I had submitted my I-751 application. I didn't submit the proof if the pregnancy with my application, as I wasn't pregnant then when I originally submitted the I-751. I did though, submit proof of previous pregnancies and miscarriages with medical notes that I had at the time, as it did prove that I was pregnant before even though it didn't work out.

And for the current pregnancy, if I am formally asked to submit addtional evidence for the I-751, through an RFE and/or through an interview I will definitely submit pregnancy and baby evidence (medical notes, u/s photos, birth certificate, etc.) when required and asked for by the USCIS.

However, there no need to submit information when not asked to after you have already applied for the I-751, I believe, as that confuses the USCIS more when additional evidence is submitted but not specifically asked for while your case is pending. So hold onto your pregnancy/baby evidence, and only submit it when required to do such.

And yes, a pregnancy definitely proves a "genuine marriage"! After all, if you don't love someone, why would you want to have a baby with them (lol...that's not even an immigration issue here..).

P.P.S. Just one more funny quirk I had to mention about I-751 approval times:

If you've filed at the Vermont Service Center:

Expect the Baby before the 10yr Green Card, as the average waiting time at the VSC is 11 months

If you've filed at the California Service Center:

Expect the 10yr Green Card before the Baby, as the average waiting time at the CSC is 4 months

Lol...Or if you're stuck in the same situation as me...Expect both the Baby and the 10yr Green card to happen at the same time!!! (see my signature for more information about that)

My fiancee has told me it's easy to pass the interview part if you can provide proof of pregancy and that the baby is yours and she is in Ho Chi Minh one of the hardest places to get a visa. I have heard others tell me that it will only complicate things and its not automatic for proof of a bon a fide relationship. I personally would submitt it. Hope this helps

I just want to reiterate - yes, the pregnancy is great evidence of a valid marriage and it is wonderful news for the happy couple. There is a big difference, though, in obtaining a visa at Ho Chi Minh and applying to remove conditions. The application to remove conditions has already been submitted. There is a big backlog of applications waiting. The application is mailed in, then sits and waits in a big storage area until someone gets around to looking at it. If the adjudicator wants more evidence he sends a letter requesting this evidence that needs to be returned back to a different address and included with this evidence. The file - which is already been worked on - is set aside in a specific area while it waits for the new evidence to come and be matched up. If the file has not yet been opened up and worked on but is in the pile waiting and new evidence is sent in, it just joins the pile further back and waits as well. They really have no way to match it up until someone starts to work on the file. By the time they reach the secondary evidence they have probably already made a decision based upon the primary evidence. Whether the secondary evidence ever gets matched up with the application package is open to serious doubt.

While I can appreciate that you would want to send this lovely news along as further evidence, it is unlikely it would ever reach the adjudicator before he/she reviews your original document. If you don't have enough evidence already they will send you an RFE or request an interview. That is the time to present the evidence of your pregnancy - and if the file is at Vermont, you may even be presenting evidence of a live baby since the waiting time is so long. In all likelihood, the decision will be made on the primary material submitted and the secondary evidence not matched up to the application until after the decision is made.

I may be wrong on this but this is my understanding of how the process works. So, enjoy your pregnancy and the expectation of both the I-751 approval and your new son and daughter - each in their own good time.

Lol...and yes, if you're filing at Vermont, and are unluckily called for an interview, you'll probably be bringing your newborn baby to the interview with you. Or if you're at the CSC, and are unluckily called for an interview there, your wife will just show up at the interview still pregnant. And in either case, if you have an RFE, just submit whatever you have pregnancy/baby evidence-wise accordingly.

Funny that in my case, who knows, if I am unluckily called for an interview in Vermont that is close to my due date, I could end up going into labour at my local (well, more 1-2hrs away non-local for me) USCIS office...lol....then they would have to definitely approve my I-751 during the interview!... :rofl:

Hmm...in your case, my guess is that you'll probably have the Baby first, be it that a pregnancy is only 9 months long, and the current processing times for I-751s at the VSC is 11 months. So by the time you get your 10yr green card, your information will more likely than not be "updated with a baby" then. On the bright side, that will give you plenty of time to collect more evidence pregnancy and baby-wise, in case you are ever asked to present such in an interview and/or an RFE later on...

By the way, if you don't mind me asking, another question: "When is your wife due and how do you and you and your family feel about the pregnancy?". Feel free to PM me too, if you and/or your wife would like to also talk about pregnancy issues/concerns.

Sorry for missing the due date question. Here's my answer: she's due at the end of July, 2009. About how we feel about it, to be short, I would say we enjoy it enormously, though that doesn't describe a whole lot.
