Today Andrew actually got the visa back. I one down.

Now here is my question, and I think it will work out but I need a little reassurance.

OK! Have K-1 Visa coming over to get married. Then after several days Andrew is going back to the UK. Didn't kind a job here and work asked him to stay a little longer. Then we start the cr-1 process, so he can come over later after that is complete.

Is this OK???? Will be get in trouble?? I think its probably the correct way to go about it.

Any ideas? :unsure:

2009-12-29: Mailed I-130 package to Chicago

2010-01-04: package arrived at USCIS

2010-01-12: NOA1 arrived Case sent to CSC

2010-03-22: NOA2 approval email and letter recieved

2010-03-24: called NVC got NVC#

2010-03-26: NVC message verified paperwork sent on the 25th

2010-03-29: Got email from NVC and paid AOS fee.

2010-04-01: AOS fee shows paid, and receive and paid IV Bill

2010-04-05: IV bill shows paid and NVC mailed packet

A K1 visa is a one entry visa. Once he enters the US with it, then it is done...toast...kaput. If he leaves the US, he will not be allowed back in. You will have to start all over with a K3 (married visa). You will pay all the same money, do all the waiting you've done to get the NOA2, submit the papers to the Embassy, waiting on an interview. That's the basic rules of a K1. Or he could apply for a CR1 which is also starting over...him in the UK...fees...time...interview. Look at your K1 timeline and plan on doing basically all of that again.

If you marry and file for Adjustment of Status in the US (not CR1 in the UK), he can also apply for EAD (work authorization) and AP (Advance Parole) at no additional cost. I'm lost on how he was looking for work in the US already without having work authorization. The AP document will allow him to travel to the UK and re-enter the US. That will take maybe 60 days from when you apply. EAD also takes the same amount of time.

You could have gotten married on Visa Waiver, then he could have gone home and you started the process as a married person (K3 or CR1). Going home right after he gets here is just throwing away everything you've done up to this point.

If he needs to finish work, then he ought to just stay there and finish. His visa is good for 6 months. Then have the wedding. Will he earn enough to make it worth throwing away everything you've spent getting the K1? (and paying again for a new visa?)

I agree, just come over on the K1 and stay stay stay, if you go back, you basically threw it all away...dont do it....seen so many couples do this on "emergency" and well they're stuck back at the home country doing it all AGAIN.........waste of time and money.

He can stay in the UK for 6 months after he has his K1 visa. He could temporarily take the position. Is it a matter of finances or does he feel uncomfortable not being able to work for a while?

If it's the latter, if he enters the US and gets married, then adjusts status, his work permit should only take roughly 2 months if everything goes smoothly, and he can look for potential jobs in the meantime. And there's always volunteering if he feels he just needs to work.

It's difficult when you have a perfect opportunity in your home country in one hand but your ticket to your loved one in the other. Just be rational about the extra time, money and stress that it may involve.

Old Mama Nich here. Married for 32 years, widowed, and starting over with a wonderful Brit. I've got a different perspective of life from seeing lots more of it than most on here.

How much are you willing to sacrifice for a man who "lives for his work"? From the outside I look at what you said and think "hmmmm...being with a person I have loved 6 years or being department manager...which one is more important???"

At some point, he'll have to suck it up and start over in the US. A year from now, he's just another year away from building a career in the US and a life in the US. Without work authorization, it's possible employers weren't seriously looking at his CV. I would think hard about marrying at this time. He doesn't sound committed to you above all else. He can extend the fiance visa if he can't divorce his job within 6 months. This is not a dress rehearsal. This is your life...get on with it.

I had a slightly different take which was....has her moving over to the UK been considered?? He likes his work, he's got a good career going, and it's pretty scary thinking about looking for work these days.

A lot of people are uncomfortable with not being able to work for some months after they get here, it's completely normal and to be expected. Fortunately, once he's here it's only a couple of months, and my experience it frequently takes nearly a month from an offer to starting work anyway, so not that long at all.

I do agree that 6 years (and going on 7!) is a long long long time, and I'd certainly be looking for a better solution than putting it off just that much longer.

If you want averages, it's 81 days to an interview according to this. Back in February it was closer to 50 days.

In regards to not having a job in the US, I was a bit worried about that too - I enjoy going to work and making money etc, but then I realised, in England it's going to be cold(er) and wet(ter) than it is now and I really wouldn't want to be going to work anyway, so why not lap up the sunshine in Florida and wait for the documents to come through! Besides, being with my fiancé is much more important to me than anything here, probably good advice to think hard about your situation!

App-girl - I agree with the others. I don't see how anyone can get job offers without having evidence to meet I-9 requirements. Is there a reason you don't want to, or can't, move to the UK?
