Hi All,

My UK fiance's interview was finally scheduled for July 31st (you can add us to the list!) and needless to say we are getting very nervous. I've been trying not to think about it but am suddenly freaking out that we don't have all the appropriate documentation. I'm a student and thus have negative income. My mother has filled out an I-134 form for us. I've just realized that I should be filling one out too but it will have $0 as my income and very little for my assets. I also didn't file taxes last year since I had no income. I figure I will write a letter explaining my situation, get a letter from my bank, and a letter from the dean of my medical school stating I am a student in good standing. On old VJ posts it sounds like the London embassy isn't too picky about this. Has anyone had recent similar experience?

Thanks for any help you can offer (and please let me know if I should be posting this question elsewhere)!

A,

I have read that you as the primary sponsor do need to fill out the I134, but you also need to provide a letter of explanation of why you did not file taxes. London specific: Please check the "DO intend to make specific contributions" box, this is frequently asked for in London, contrary to the example forms on VJ. Your cosponsor should especially do this.

From the I864 instructions (frequently referenced because consulates sometimes use them as a guide since the I134 doesn't have much guidance attached):

If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

More detailed time line in profile.

Thanks for the advice! I will do that. I checked the "DO intend to make specific contributions for living expenses" box and said "I intend to provide support for all living expenses." Hopefully that will suffice. I can't wait for this to be over with!

I have another and hopefully final interview July 24th, had been banned for an overstay and so ban is lifted July 23rd, will fly to UK Friday to get ready for it. Am very nervous as I reckon we won't try again if it fails this time. This time round we are in same country, so we won't be separated, in Cyprus now but based in UK.

No AOS yet. We are leaving everything to the last minute (which I'm nervous about). We get married 22nd August which is 87days after I arrived. We did this to work around family & friends so they could make it to the wedding. We may file AOS a day or 2 after the 90 days but I think that's allowed.

Tried to get my social security number yesterday but some silly woman at the SS office wouldn't let me apply without work authorisation! I may have to wait until I get my green card.

All part of the stressful process that is immigration. lol

We are planning to file for AOS around Sept 1! So we will be around the same time :) We have until Sept 7. We get married Aug 15, but then are going to Florida for a honeymoon directly after. We have most of the forms ready to go though, so it shouldn't be a problem. We just need to do the I-864 and get someone to transcribe the medical stuff.
