So our interview took place on the 18th of September. I'm worried about that denial letter, I want to completely abandon the K-1 process and just marry my fiance in Colombian.

How long does it usually take to receive it?

K-1 Timeline

I-129F Sent - 3/4/2008

I-129F Recieved - 3/5/2008

I-129F Approved - 5/7/2008

Interview Date - 8/26/2008 - (Asked for petitioner to be interviewed as well, new interview Date 9/18/2008)

Interview 2 Date - 9/18/2008 - (Case Sent to review, and not DENIED as I orignally thought)

Gave up on K1 process - 9/19/2008

Canceled K-1 Petition - 5/1/09

Married - 5/30/2009

Recieved K-1 2nd Approval (HA!) - 6/6/2009

Long Honey Moon - 5/30/2009-10/14/2009

I-130 Timeline

I-130 Sent - 12/22/2009

I-130 Recieved - 12/23/2009

Received NOA1 Hardcopy - 1/4/10 (Dated 12/29/09)

NOA2 - 3/9/2010

Write them a notarized letter cancelling your petition.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Cancelling a denied K1 can cause issues later. You need to find out exactly what the reason for the denial was and make sure you have addressed it in your next petition no matter what type it is. Have you gotten a notice it is back yet or has your case status online changed? It can take a long long time to get a NOID

I cancelled my first K1 when it was back at USCIS. I already knew why it was denied before it was sent back from the embassy.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

There is another couple on one of the other threads that got married before they did anything with their I-129f. The USCIS denied the I-130. It's risky. Most of the time, from what I have heard, they expire the I-129f, but you don't want to refile until it has been settled. Don't take this lightly.

As for the original question, ours was denied in Aug of 05. It was received in the CSC in Dec of 05, and we didn't get the NOIR until July of 06. Keep in mind that ours was the CR1, so it would be different.

We have a member similar to your situation, I am trying to remember her screen name, but it slips my mind, but she is often found in the MENA forum. Perhaps she can assist you with this if you post your question there.

ours was returned to calif and left to expire and NEVER received a word from them, our rep did contact Calif and they sent her a email saying it had expired and we were free to refile, now i dont know how Vermont works but i know of some k1 filed and returned almost 2 years ago and nothing new but i also know of a couple that went back thru vermont and actually did get a review and now he has visa. Thats all i know of my own experience and i NEVER received any formal letter, we refiled and so far no problems thru the cr1

I guess I'll make a call to the uscis and find out. But we do know why it was denied and recieved a letter explaining this during the interview, we got a 212(a)(5)(A). But I thought I was supposed to receive an official letter about the denial.

Oh a 212 is different than what many of us has gotten. I got the 221(g). I can't be of assistance with that one since I know nothing about it. Have you gone to this forum yet? This forum is specific for denials, and hopefully they can help you more.
