hi everyone, i read some stuff about which petition came first, the I 130 or the K3? please share me stories those who got the I 130 approved first for his or her CR1 or IR1 then dropped the k3 or just abandoned that route because the CR1 or IR1 came first....share stories please

Oct. 27, 2007...my beautiful son is born

USCIS IR-1/CR-1 Visa Journey

Service Center : Vermont Service Center

Consulate: Manila, Philippines

Feb. 05, 2009: I 130 sent

Feb. 12, 2009: NAO1

Feb. 17, 2009: first touch

Feb. 18, 2009: Touch

May 01, 2009: Touch and NAO2 mailed...yeah hey!

May 08, 2009: NAO2 in the mail

NVC Journey

May 15, 2009: NVC case number

May 18, 2009: Gave email add to NVC

May 28, 2009: Received DS 3032 / I-864 Bill

June 1, 2009: Paid I-864 Bill

June 5, 2009: sent AOS stuff

June 29, 2009: sent DS 230

June 28 - Aug. 8: i spent time with my boys in the philippines

IN A BIG HUGE BLUR...OUR CASE WAS COMPLETED AUGUST 5, 2009 (AFTER RFE: HUSBAND'S ORIGINAL BIRTH CERTIFICATE) AND MY HUSBANDS INTERVIEW WILL BE SEPTEMBER 25, 2009...WE HOPE AND PRAY WE GET IT!

CURRENTLY DOING: PREPARING DOCUMENTS FOR MY SON'S PETITION!

The process has changed a couple times but the current policy is to put both petitions together and approve them the same day if possible. K3 is a visa, not a petition. You would be filing an I-130 petition and if you really want a K3 visa, an I-129F petition using the "for a spouse" instructions.

Facts are cheap...knowing how to use them is precious...

well..I have a question..I know USCIS gives approvals of the both petition at the same day more or less. What is the benefit then? Does it help to schedule an interview earlier? Otherwise, what can be done if the I-130 and I129f get approved the same day?

Good question!

Actually doesn't make much difference in the final out come as the I-130 can get hung up at NVC for an undetermined time depending on how deligent you are with the paperwork.

I-129F normally moves out of NVC automatically to your embassy.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Good question!

Actually doesn't make much difference in the final out come as the I-130 can get hung up at NVC for an undetermined time depending on how deligent you are with the paperwork.

I-129F normally moves out of NVC automatically to your embassy.

End of the day, I may not have issued K3 by the CO (non-immigrant visa issuance solely depends on luck though) and may have to wait till the NVC work is done...Everything is so uncertain....

I don't know about other countries, but here in Bangladesh, I will be the first one ever to have asked for a k3, in their website they don't have such catagory of non-immigrant visa :blush: . Funny HUH!!! So, lets see....

The visa process is quite different for the two petitions after USCIS approval.
