Made it so far, what to do next?

Hello everyone,

I came to the US in April 06, our marriage was arranged but not to cheat immigration laws. Our marriage always have been ups and downs. there was only period of six months when our marriage went ok after that struggle to achieve success in my career of medicine and family factors ruines our marriage life.

On top of everything my wife's angry and bi-polar kind of mood always takes the #### out of me. We filed jointly for conditions on GC in Feb 18 and now it has been almost 9 months since my bio-metrics has been done. (my file was transferred to Vermont Service Center). Meanwhile we moved to other place and I have never seen her wild behavior in my life. She was expecting me to earn money and I did, paid all half of bills and also paid my personal expenses and I was sort of money so I asked her to give me money, she did. Now she hated me whatever I do even though there is nothing wrong with it. Everything about me annoys her-like right now I have terrible cough and in the morning my head is bursting due to headache and throat full of cough and I am clearning my throat and she started to yelling that every morning I make terrible noises. (I expect any partner to ask his/her partner when other is sick to take medicines or see doctor). I mean so many of these little things have made our lives miserable together. I tried to convenience her to get counselor help so many times but she is like counseling is bullshit. She is like she has no time. She made appointments for opthalmologist to get free glasses, to remove her wisdom teeth and done them all but no time for her painful life.!! I am like so why the hell I am trying to work it out. Worst come worst I will be on the road right after the end of this marriage. I have guts to raise myself from scratch as long as I am legal in the US. My parents back in India always there for me, but they cannot do anything for legal matters.

Now back to the point, I have made it so far and given my final shots to work this marriage out, but personally I feel that now I should and must get out of this relationship. But again, here comes my condition removal. I tried to send as many as documents as possible to prove our living together and to prove marriage was not fake. My file submitted on VSC on Feb 18, 08, bio-metrics on Mar 20, 08. I see from forums that it takes 10 months from bio-metrics to get the GC. It has been 9 months and now I dont want to make any decisions in hurry. I was thinking to report our relationships to USCIS in written that relationships are not stable right now. But I want to get opinions from this reliable visajourney experiences.

So should I report this problems to USCIS?? I have not received any request for interview or request for more evidences on today date Dec 24. 10 months is going to end on Jan 20.

Sorry to hear you're having difficulties. Have you notified the USCIS of your change of address? I would start by contacting them to establish that they have your address right and then go from there.

You can lift conditions without her, but as you've already filed then you can still proceed with separating/ divorcing her if this is what you want to do and you meet the criteria to self-sponsor.

Sorry your marriage is not working out. You know, we all (or most of us) have ups and downs in our relationship, so give it another chance to work it out, if not you can always file for divorce. Now, I don't think you should report your problems to USCIS, however you must report if you file for divorce, by submitting another I-751 with waiver, and start whole I-751 all over. What I'm not sure of is whether or not you have to wait for divorce to be final, to submit another I-751, and if that's the case, I would think you will have decision on your current application before divorce becomes final.

Also how long have you been married?

Sorry, not according to the bulletin linked above and issued by the USCIS:

If the petitioner and beneficiary filed an I-751 petition jointly but:

  • separate before a decision is made on the I-751, the beneficiary should notify the NSC that he/she is currently separated by mailing the explanation to the NSC via PO Box 82521, Lincoln NE 68501-2521.
  • get divorced while the I-751 petition is pending, the beneficiary should notify the NSC that he/she is divorced, and submit a copy of the divorce decree to the NSC via PO Box 82521, Lincoln NE 68501-2521.

Well than I guess this should clear up some questions for OP

But my understanding is that OP is not divorced and he still lives together with his wife, abviously they are thinking about divorce but nobody knows when and if thats going to happen.So what OP should tell USCIS? that they are legally married, live together but having arguments and they someday may file for divorce? You could be right but i just don't get it. :blink:
