Hi There,

I obtained K-3 Visa whereas my I-130 and I-129 were approved at the same time. Now I came to know the a K-3 visa holder will have to apply for AOS incurring a fee of more than $1000, whereas if I had obtained CR-1 (I-130 route) visa it would not have been required. I have planned to travel to US after two months. Please advise if I can still get CR-1 Visa. Will it cost less if I get CR-1 and then travel. How long should it take if I want to obtain CR-1 now.

Sept 8, 2010 - AOS Approved for 10 year Greencard!!!

The soonest you could interview for the CR1 would be about three months. You would save about $500, since there's about that much in visa and AOS form filing costs not yet paid on the CR1 path. A denial is always a possibility. The bigger financial concern may well be time that you are unable to work, as you'll be waiting at least three months for work authorization after entering on a K3. Of course, unless you already have a firm job offer, it could take that long or longer to find a job regardless of visa category.
