Hello Fello VJs,

I would like to ask your advices... Please help us. The last time we had the RFE was November, 14 and we're asked to submit additional evidence. The documentation needed is the Original divorce paper from Japan since my fiance was married and was divorced in Japan. Now, the RFE needs to be completed in after one month but our lawyer is so slow working the papers. Just today I got an email from the USCIS that we are denied... I am so mad, sad and broken. I could not understand why these things happened.

Is there anyone from VJs who got this problem too? What's the best thing to do? Can we still asked for an extension so we can continue with the application or we need to start from the beggining (which I hope not)? We paid our lawyer a big amount so he will take care of this but he's no good. He's just collecting our money and doing nothing. He is also my fiance divorce lawyer in Hawaii since they married in Hawaii and in Japan, he also needs to be divorced in Hawaii and when he knows that we are processing our visa, he then volunteered to process it but it turns out to nothing. Please give us advice. Thank you.

I'm so sorry to hear this. I would have never sent the petition without the basic required documents in my hands. Why did you guys decide to use a lawyer instead of do-it-yourself? I would think that the lawyer should give you a refund on his fees and the filing fees because the instructions CLEARLY state that divorce decree(s) should be sent with the forms.

You may also have the right to appeal the denial...but I am by far no expert. I'm sure they will be along shortly. Best of luck on your journey.

Jan 20, 2010 ~~ USCIS acknowledged receipt of RFE on I-485 only

Jan 22, 2010 ~~ I-131 AP and I-765 EAD approved (email notice on 1/25/10)

Jan 28, 2010 ~~ USCIS email that I-485 was transferred to CSC on 1/26/10

Jan 30, 2010 ~~ Received EAD and AP via US Postal Service

Feb 01, 2010 ~~ Received notification of case transfer via USPS

May 07, 2010 ~~ Email notification that card production ordered for 1-485

Jun 01, 2010 ~~ Greencard finally arrives w/approval date 2/23/10 (Huh??)

Done until November 25, 2011!!!

Unfortunate, this is a very common result when a lawyer is used. There are far more of these horror stories from people who paid a person who is there for the MONEY!!!! LAWYERS are money driven. They do not care how long the case will take. They do care how long it takes for the check to clear!!

I agree and If it were me I would take him to court for a refund! It is very easy to do it yourself, after all the guides, papers and people help you here HEAPS!!

07/17/08 Arrived and picked up by CSC

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

its true that you supposed to gather all the required documents before you file.....and it so happen that the divorce decree is one of the main requirements....how come your lawyer aren't aware of these?

If I were in your shoes, I'd gather all the required documents and file again. Good luck getting a refund from your attorney but it's worth a try. This is the expected result when the required documents are not submitted with the petition.

As you go forward, you'll find that "semantics" are critical. You've applied for nothing. Your petition was denied. Unfortunately the denial is both justified and final.

Facts are cheap...knowing how to use them is precious...

I wish I have known VJs before we submit but I just knew this site after 4 months and ours is some kind of a special case... I wish we didn't have to get a lawyer. Thank you for your advice. I hope to hear from someone who is of the same case with me and got approved. Thanks all of you.

You've gotten a lot of advice. Save trying to get a refund from the lawyer for later. Right now, you should be making an application again, and getting all your papers together for resubmission to refile. You mentioned that you got a lawyer because you have a "special case"? What other issues are you dealing with that might have impacted on your getting a denial? Unless I'm missing something, your lawyer didn't get the RFE back in time, and that was the cause. If there are no other "issues" which make your case "special", maybe do the work yourself now.

File a new petition, this time with all the required documents, and get back in line for the NOA2. That's about your only choice. This time, do it yourself. I assume you have copies of everything that was filed before (or, if not, can get them from the lawyer).

Dear Gracie,

Don't give up.

Ask you lawyer for a refund. He should have known NOT to submit the petition to USCIS without completing everything. It's ok now to show this atty how upset you are. You can stop kissing his a**. Get rid of him.

Get back all the documents. File an appeal and/or re-start from scratch. But this time, get everything ready and assemble the documentation yourself. Use by VJ's step-by-step guide and ask around in here often.

actually you can sue a lawyer for malpractice just like a doctor from what I have seen you can win this case, I have seen it happen before you have the evidence to show he was careless in prepairing the paperwork. Good Luck
