Timeline

I am the beneficiary and I was wondering about the Affidavit of Support that my fiance will have to fill out. In 2007, he was attending school and did not work that summer, and he did not file taxes. Will this be a problem? He has his tax forms from 2005 and 2006 and worked a few months in 2008, so he will have tax form for 2008. Right now he is just working for a friend and they split the profits. He does not have any pay stubs... pretty much he cannot show he is making 125% of the poverty line. His sister is willing to sponsor and she has all the needed information.

Will everything be okay?

Will they both have to fill out the I-134?

What will he write for his income.... if it varies every month?

Please help... thanks :)

NOA'S Received: March 19, 2010

RFE: March 25, 2010

Case transferred to CSC: April 19, 2010

I-134 is needed at interview not when filing I-129F.

IF you are just starting, more than likely interview will happen after US citizen has filed their 2008 return and can use that return with the I-134.

Thanks... oh so just use the income that is listed on the 2008 form... which will not be very much. But since it is below the guidelines that is why we will be having his sister sponsor. This will work right?

Will need to ducument income for the I-134, and IRS.

If using a co-sponsor then this is less of an issue.

Moving this to Consulate/embassy forum since I-134 is used only at the visa interview.
