We want to submit the AOS papers at the beginning of January,because I have an appoinment on Jan,9 at a civil surgeon.It was so hard to find one in LA!!!!!!

My q is:does my husband have to submit W_2 and tax returns for 2008 also.He will not have them yet until end of January of maybe Feb.How can he take them earlier?

does he have a "pay stub" from the employer that shows YTD earnings?

If you're submitting at the first of January, I think your latest tax return is 2007 because 2008 returns aren't due until April 15. You could submit with the I-864 some photocopies of his latest pay stubs to help show his current income, along with the tax return and W2 from 2007. If they want more down the road, they can ask you to show 2008 at the interview or through an RFE. Right now 2007 is "latest" in my opinion.

Ask employer if he can get them earlier!

Ask employer if he can get them earlier!

From an evidence standpoint, a W-2 alone without the corresponding 1040 ITR is no better than the final YTD earnings paystub. if available

We'll send w-2 from 2007,2006,2005 and income tax return from 2007 and paystubs for the last 3 months(Oct,Nov,Dec).

I read in the instructions(form-864)that if we provide copies of tax return-and this is our case-we provide tax returns for 2007,we must include a copy of w-2 and 1099 that relats to tax reurn.and we'll submit w-2 for 2007.besides we'll submit w-2 for 2006 and 2005.so in my opinion w-2 without 1040 it's possible.tax return without w-2 is not acceptable....That's what I understand...:(..Do you think I am wrong?

What about 1099?I see that we must send this too.

....But I think I know what you mean..that is wierd to send w-2 for 2008 without tax return for 2008?Right?
