Laid off from job before AOS filing - help!

Timeline

Hello everyone!

I recently was laid off from my job and have hesitated filing for unemployment because of our K-1 visa. I am aware that we are able to ask a friend or relative to file a I-864 as a joint sponsor and we plan on doing so.

My questions are:

1. Would filing for unemployment affect our status at all or jeopardize my fiancee's K1 status?

2. If I have a Joint Sponsor, do I also fill out a I-864? (this is unclear on the form)

You have a similar situation with my husband. He was laid-off soon after I came over here in the US. He filed for unemployment benefit and apply for my AOS right away. Luckily we don't have any RFE's during the process and no interview at all so I was given my GC five months later with no problem.

05/21/07 : I-129F Sent

02/24/08 : INTERVIEW

12/12/07 : MEDICAL

01/09/08 : VISA IN HAND

03/06/08 : Arrive in the US, POE - DETROIT

AOS

03/28/08 : Mailed AOS Packet

04/12/08 : Receive NOA's AP, EAD

05/02/08 : BIOMETRICS

06/11/08 : EAD CARD IN THE MAIL!!!

07/02/08 : GREEN CARD PRODUCTION ORDERED

07/07/08 : GREEN CARD IN THE MAIL & WORKING

03/27/09 : Driver's License issued

Removing Condition

04/03/10 : mailed to Vermont

04/08/10 : NOA1 & 1 yr extension

05/20/10 : Biometrics Appt.

11/19/10 : Interview/Approval

1) NO :no: Unemployment benefits have NOTHING to do with a non-immigrant's status.

NOTE: US Citizen is drawing on a benefit NOT the non immigrant.

2) YES :yes: The petitioner (Person ho filed the I-129F) MOST Sponsor the intending immigrant so must provide an I-864 as primary sponsor. Joint sponsor also provides an I-864.

NOTE: Unemployment is NOT a means tested benefit, it is paid out of insurance paid for by your employer.

So YuAndDan, if the beneficiary is entitled for unemployment benefits (from H1 to AOS) - is that okay too to ask for those benefits?

I worked for 2 years and was laid off in end of October, before I applied for AOS and I married my USC hubby. Or should I wait to get the green card? How long can you wait to ask for employment benefits after you were laid off? And will it interfere with my removal of conditions in 2 years?

Hi!

My husband got laid off a day before we sent the AOS application. We just took the risk eventhough it was scary but thanks God that I already got my AOS interview next month and he was called back to work just a week ago.

I was also very hesistant for my husband to apply for unemployment for the first week he got laid off becuase I was scared because I had my AOS application but we were advised by my Filipino Friends better to apply for unemployment checks. So, my husband did apply and everything went good.

Just have faith in God!
