For the AOS interview a good piece of evidence to bring is the 2005 Joint Tax Return.

X - I filed my 2005 taxes in January 2006

X - we married in March 2006

X - my partner filed taxes in April 2006

Since these are 2005 taxes, and we were married in 2006 there's no reason my partner should have filed "married but seperately" is there? Yes she was married in 2006, but not in 2005 which is the tax year being reported...

How and should we get a joint tax return to bring to the interview next month? We didn't file jointly for 2005 taxes because we weren't married in 2005 and I filed 2005 taxes (January) before we got married anyway (March).

Yep, i'm confused and if anyone has any knowledge of how the joint tax return process works and how it applies to us, it would be helpful to hear it.

25 March 2006 - Mailed AOS package to Chicago! (I-485, EAD, AP)

28 March 2006 - AOS package recieved (day 1)

4 April 2006 - I-130, I-765 (EAD) NOA date by USCIS. NO AP, yet. (day 7)

6 April 2006 - Checks cashed (NOT AP)

7 April 2006 - I-130, I-765 NOA's recieved in mail! (day 10)

10 April 2006 - I-131 (AP) RETURNED. Should have mailed it to Nebraska Service Center <confused> (originally sent it to Chicago Lockbox with AOS..) (day 13)

11 April 2006 - I-131 mailed to Nebraska as requested (day 14)

14 April 2006 - Bio appt letter in mail (day 17)

17 April 2006 - I-131 (AP) NOA1 received(day 20)

2 May 2006 - Biometrics completed I-485 and I-765 (day 35)

9 May 2006 - I-131 (AP) RFE email recieved, RFE request by USCIS. (day 42)

13 May 2006 - RFE Recieved, missed a bunch of stuff? (day 46)

15 May 2006 - Mailed requested info back (Nebraska) (day 48)

22 May 2006 - I-485 Interview Notice Arrived! (July 13th)! (day 55)

22 June 2006 - AP Approved (day 86)

29 June 2006 - Interim EAD success in Denver DO.

13 June 2006 - Interview. "not concrete approved", received two emails later same day approving I-485 and I-130. "welcome notice was mailed" and "approval notice was mailed"

17 July - I-485 Welcome notice received and I-130 approval received

18 July - I-485 "after approving your application, we ordered you a new card" email received.

24 July - GREEN CARD RECEIVED! All info correct. Apply to lift conditions 7/13/08

This is pertaining to people who where married to that person before or they were previously married to another person, not the benificiary. You do not need to have joint tax returns if you were not married, plus the law states that you could be married and file separate tax returns. It is a little conplicated but you will be alright just take the tax returns both of you have.

You're right , you cannot file taxes jointly UNLESS:

Married Filing Jointly:

You were married at the end of 2005, even if you did not live with your spouse at the end of 2005 (www.irs.gov)

Don't worry too much, just bring the taxes & other referenses that you might need during the interview.

My hubby also filed "single" for the first 2 years of our marriage since I was still in my home country. When I moved here, we filed "married file jointly". For our AOS, we submitted the 2 years as "single" and 1 year as "married". No problem at all.
