Today I sent in the I-130 packet to begin the K3 process. I double and triple checked everything but as I was browsing the forums afterwards, someone raised a question about K3 vs CR1. Apparently, CR1 only takes a month or so longer and you won't have to deal with AOS afterwards. My wife is from Thailand and she just finished her final year in college. Around this time next year she has to go back for graduation with her king, which is very important to her but it will take a couple months and I will also be going with her. With this in mind would a K3 or CR1 be better in my case? Since I have already sent the K3 packet can I drop that and start CR1?

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

alright thats good but how does the AOS work? When do we have to file it? Does she have to stay in the country while we do? Does she need to have the AOS filed to be able to work, get a drivers license, etc?

If/When you get a CR-1 visa - and enter the US - you will not have to adjust status (file AOS) - you will receive a 2-year green card several weeks after arriving. This means being able to work, get a social security card/number and obtaining a driver's license almost right away. :thumbs:

11/08 sent letter to cancel OLD I-129F (2005) petition so no problems

11/18 received confirmation (email) letter received (VSC working on the old I-129F) quickest response ever from any governmnet agency !!!!!!!!!!!!

11/08 13 letters sent to Senate Judiciary Subcomittee Immigration

11/25 mailed me for more evidence, don't understand this delay new

I-129F (05/08)

11/29/08 received request for more evidence.......I forgot to check "NO' for domestic violence, homicide, manslaughter etc etc,

how stupid of me gezzzzzzzzzzz someone KICK ME please.

Also received action to the old WAC petition I-129F to reopen to withdraw petition.

12/01/08 I checked the "NO" box and sent in to VSC.

12/02/08 requested expedite services (need life saving operation)

12/06/08 received email new I-129F back in process mode

12/19/08 denial to expedite petition (unbelievable)

12/30/08 USCIS sending why the denial old I-129F (cant wait to get that response)

01/03/09 Finally received both NOA-2's today, my heart cant take it.

01/09/09 Received 1st letter from NVC for $70.00......no no no I want to process the I-129F. Got my birthdate wrong, have to fix that.

03/24/09 Interview........DENIED HK

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Of course. As with most "mistakes" or "errors" the resulting "harm" is unintentional but no less real. The cure is to intentionally use the skill necessary to avoid the harm whether one's own skill or borrowed from others. In any event, the errors need to be corrected here and teaching moments not wasted.

ah ok, which one should I do though.

Take your pick!

CRs are immigrant visas and receive their GC and SS card in the mail shortly after arriving in the US.

No need to go thru the $1010 cost, stress and hassle of doing the AOS. No need another interview or do biometrics.

K3s are nonimmigrant visas and have to go thru AOS. It can take a LONG time to get GC. Can be denied and deported also. Rare but the chance is still there.

If the relationship or petitioner goes “belly up” before the beneficiary has GC in hand they stand an excellent chance of being deported.

At this time if done properly it only takes about a month longer to do the CR-1 or IR-1.

The CR-1 receipient can almost immediately work, get drivers license, joint bank accounts, and anything else where a GC and SS card are required .

K3 visas have to wait at about 3 months for EAD so they can get a SSN.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
