I am sure this question has been asked and answered before but I can't find anything that is really helpful. In October my SO was denied entry to the U.S. His passport was stamped and then the stamp was crossed out and handwritten "stamped in error" was written in it. I have a copy of the I-877 that he was given while he was in custody of CBP. it was determined that he had insignificant ties to Denmark. My question is this - are we going to have to pay $545 and file the I-601 and if so, exactly when and where do we file this? Any help will be appreciated and sorry if this has been asked and answered.

No...no waiver - this (the reason you stated) is probably one of the most common reasons for being turned away (denied entry). One less thing to worry about.

Just an fyi...my husband was denied several times while we were going through the waiting period for k-1. At the interview, they had his picture and all the notes

related to the refusals (same reason...lack of strong ties to Canada). The interviewer had a good chuckle at how scared my hubby looked in the pics and he deleted them. At the POE, the officer there had a hard time trying to get rid of even more info on the refusals. There were some other text messages he had to delete, he was new & didn't know how to.

My point is, if you have a form, you might want to hang onto it for the interview just in case. Probably not a big deal, but if you had to prove it was just a matter of

lack of strong ties, you'd have something.

3/5/11 sent LOC paperwork

3/9/11 date of NOA

?/?/?? biometrics appointment
