Hello,

Just curious, when a spouse secures a CR-1 Visa, the Green Card has an expiration date of 2 years from the date of entry, correct?

So what happens after 2 years? If we find that it won't work out and we split before the 2 years is up (with no kids), what happens to her case? Does immigration automatically send out the new Green Card after 2 years, the permanent one? What if the alien is no longer married?

Please advise.

Hello,

If everything is fine you have to apply for her CG 3 month before due date

90 days before the 2 year green card expires, she may apply for the removal of conditions to her Green Card. If she is divorced, I believe it will need to be proven that the marriage was entered into in good faith.

Are you sure about this? I thought that only applied for Fiance-type Visa where you go in for another interview to show that you actually got married etc (because you have to get married within 90 days of her arrival here).

However, for the case of a Spousal Visa (CR-1), is the same true? I just want to make sure because I did not see that process anywhere. So what you are saying she has to get an application and fill it out, send it in for "Removal of Conditions?" within 90 days of Conditional GC expiration?

What if a person never applies for this removal of conditions? What happens then?

Yes I am sure about this. If you are granted a CR-1 then you will need to file the I-751 to remove conditions. You may file if you are separated or divorced.

If conditions are never removed?!?! I am not sure.

I am sure. My friend did it for his wife and she just got GC after 18 month waiting with wonderful Vermont!!!

Thanks. So if a person never actually APPLIES to remove conditions, that person will not get the new, Permanent GC in the mail? Then they are here illegally I suppose, technically speaking, right? Without a Perm GC and the conditional one having expired.....

People just dont' get Green Cards in the mail. they must apply and be approved for them.

What if I am Late in Applying to Remove the Conditions on Residence?

If you fail to properly file the Form I-751 (Petition to Remove the Conditions on Residence) within the 90-day period before your second anniversary as a conditional resident, your conditional resident status will automatically be terminated and the USCIS will order removal proceedings against you. You will receive a notice from the USCIS telling you that you have failed to remove the conditions, and you will also receive a Notice to Appear at a hearing. At the hearing you may review and rebut the evidence against you. You are responsible for proving that you complied with the requirements (the USCIS is not responsible for proving that you did not comply with the requirements).
