Do you think it is a good idea to do the I-130 stand alone at the rate things are going at VSC? With even 08/08 filers being transferred to CSC is it a good idea for me to drop my I-129F. Please reply need some input here.

Sept 8, 2010 - AOS Approved for 10 year Greencard!!!

Well girl. I did call and they say you can submit your request to withdraw in writing. I was like wow more writing. I tell you these people. Anyway, it takes awhile to process so I guess we better just wait. I hate being away from my dh! I am so so so ready to be with him again. This waiting game is getting the best of me!

Withdrawing an I-129F for spouse is a good way to get your whole case messed up. You may simply push forward with the I-130 and decline to or delay responding to the P3 for the I-129F. If you want an immigrant visa, don't file an I-129F for spouse. If you want a real mess, file it and then withdraw it.

Facts are cheap...knowing how to use them is precious...

Ignore anything you get from the embassy concerning the K-3. Move forward with the NVC process for the I-130. You don't need to withdraw anything. By filing both forms, you have applied for both visas. Like Pushbrk said, contacting them to withdraw a petition could possibly get the whole thing withdrawn.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Sort of. Nobody has applied for any visa yet. That comes only after a petition is approved. There's lots of discussion on the subject including how to leverage the K3 case to potentially get an earlier CR1 interview. You'll have plenty of time to read up on that (Please don't make me type it again. Just find it in one of many earlier posts.) but for now, just don't withdraw anything.
