k1 Holder can work with EAD only (Employment Authorization Document) - when you adjust status (here in the US) you can petition for EAD as well - takes something like 70-90 days to get.

You are work authorized until your I94 expires. Beyond that, you must have an EAD or green card to legally work.

An employer needs documention to hire an employee legally. The OP has no such documentation. That K1 is work authorized is a technical truth but without supporting documentation, they don't get "employed". Please stop misleading people.

Please help me understand what is misleading about "work authorized until your I94 expires and beyond that you must have an EAD card/green card".

Is that an untrue statement? Are "technical truths" true or untrue?

K1 visa holder are not authorized to work unless you have EAD (Employment authorization document). You need to apply for that, some do it together with AOS. The $1010 fee is inclusive of EAD.

The employer will ask you if you can provide legal papers that you are allowed to work in the US, and that is EAD. So what you can do is apply for AOS and EAD now.

K1 visa
12.20.07 : NOA1
05.01.08 : NOA2
05.27.08 : MNL case number was received in the US

09.10.08 : applied for SSN

AOS

11.24.08 : Check encashed (day 7)
12.17.08 : Biometrics! (day 30)

As usual, common courtesy would have helped with emulation of the point. I think things could be better described as 'technical situation' rather than a 'technical truth'.

Your statement is misleading because a person is not "work authorized" until he or she has an EAD card. The only way that I know of that you can be work authorized without an EAD is to have the temorary work permit, which is given at ports of entry( and the only port that has been reported to give such a permit is JFK). When the I 94 expires, then of course the temp. work permit would become void. So one is not permitted to work legally until the I94 expires(unless you have the temp. permit).

I'm sure you did not mean to mislead anyone. :hehe:
