HEY GUYS,

ON FORM I-864 I HAVE ONE QUESTION. ON QUESTION 24 PART "B" Income you are using from any other person who was counted in your householdsize, SHOULD I PUT THE JOINT SPONSOR THERE? BECAUSE BELOW THAT I HAVE PART "D" AND "E" WHICH "D" STATES The persons listed above have completed Form I-864A. I am filing along with thisform all necessary Forms I-864A completed by these persons. AND PART E STATES The person listed above _______ does not need to complete Form I-864A because he/she is the intending immigrant and has noaccompanying dependents. SO WHAT SHOULD I DO BECAUSE I'M THE SPONSOR BUT I AM ALSO GOIN TO FILL OUT A I-864A JOINT SPONSOR W/ MY HUSBANDS UNCLE SO WE CAN BE ABOVE THE POVERTY LINE. PLEASE TELL ME YOU UNDERSTAND. WHAT SHOULD I PUT IN PART "B" "D" AND "E" IF I;'M FILING AN I864 W/ A JOINT SPONSOR? :wacko:

Do you or does your uncle reside in your dwelling? If so, put his name as you are submitting an I-864A. If he does not reside in your dwelling, then you are not submitting an I-864A, your unclue should be submitting an I-864 that is seperate from your petitioner's I-864.

If your uncle is in your dwelling:

24. B ) - list his information

d)- Check this box and include the I-864a and all required information.

e)- This has nothing to do with your uncle. so leave it be. Check this box only if you are including any income/assets that your spouse/fiance is bringing with him/her.

Uncle lives with you - I-864A. If he doesn't - I-864.

MY UNCLE AND I FILLED OUT THE AFFIDAVIT. BUT I WAS TOLD THAT IF I HAVE A JOINT SPONSOR WE BOTH HAVE TO FILL OUT AN I-864 AND A I-864A. AND IF I PUT THAT HE IS LIVING WITH ME, SHOULD I PUT HIM ON MY HOUSEHOLD SIZE. THAT IS PART "G" OF NUMBER 21? AND CAN I PUT HIM BECAUSE HE'S NOT MY UNCLE, HE'S MY HUSBANDS UNCLE. We had something similar with our application. My wife's father was married within the ast year, but his tax return states otherwise. We put the most up-to-date information. In your case, and to avoid confusion, i would have your uncle submit an I-864, not an I-864A and have him list his current place of residence on the form, but list your place as the mailing address. By doing this, you won't be lying to the state and if your uncle moves again, the state can reach him through your mailbox.

Put nothign for 24 e. It doesn't apply to your uncle. It's applicable only if you list your spouse/fiance as a household member. On your I-864, you would put his name and check the box. See the example forms.

You either fill out and submit one or the other. Not both. If you fill out and submit both, it will confuse USCIS and you will likely receive and RFE and be asked to submit an I-864 if your uncle does not live with you. Which he doesn't. Fill out and submit the I-864 only.

submit both only if there's some weird reason why one would submit both an I-864A and an I-864 - I've never read of a situation that requires this. If someone knows, please enlighten us.
