okay guys here is the thing im from a small city here in New Mexico i dont have advantages as some may from like New York....but that doesnt mean i have to sit here and do nothing i have to wait for Monday but as soon as 8AM comes I'll be on that phone to find out just where my congressmen and my senators are at so i can travel to their cities and cry for their help.... a good friend told me i should go to them in person.....they have small offices here in my city but they are closed until after the New Year....so this makes me want to pull all my hair out but i have to be patient.....that is what i did first thing the day i found out he got denied....but every where i went was the same closed until after the holidays.....anyways ill let you all know as i know.... Thank You from the bottom of my heart.... without you all i would know nothing really im oblivious to all this..... Bernice

I think going to their office is a great idea. You need to convince them as well that your relationship is real. Have you been working on some letters of support from yours and his family and friends? Keep collecting proof, and take what you have to your representative. I do suspect that it has to do with the language barrier as well, so you should be collecting evidence on how you do communicate. Is there any other red flags?

Although the offices are closed, keep in mind that the holidays will also slow down processes at the consulate as well. Don't give up hope, keep pushing. I have seen it turned around before it was sent back. Martiniolive just did it recently. Perhaps if you can contact her she could give you tips, but I would bet her husband is here now, so she may be busy.

Even if they actually do send it back you can still get the visa, it is just very time consumming. My husband was denied in 05. It was a big confusion about his sister and ex brother in law that is here in the US. They thought that these 2 were married and divorced (visa fraud), and that she paid me to marry him. But the truth is that the ex brother in law is from a different sister that has never even been here. So sometimes things get confused by the CO, and the most important thing is to try to figure out where the disconnect was and fill in the gap. My husband has been here now for 2 years. He has his 10 year GC, and although it was a battle, it was well worth the fight.

I didn't have the information that we are giving you. Chi, Kiya, and myself have had to learn this the hard way. Kiya was a K-1, but mine and Chi's were a CR1. We all have knowledge on this process, and we are all willing to help you to overcome this. Just take one step at a time. Don't allow yourself to feel overwhelmed. Take the weekends off and just be normal. You need this time to prepare for the times that you will be fighting them. Don't allow depression to take over, it is self defeating.

If by chance they do end up returning the petition it might be a good idea to try to find a way to visit him again. It helps in two ways. First this will be great evidence when you receive the NOIR, but more importantly it will give the two of you a little time to heal from this and build strength for the battle ahead.

One other note. My representative that helped me the most was based in Washington. So you won't necessarily be working with someone that is living in New Mexico.

You can look your rep up in your computer, mostly you would be working with a rep from their office that represents them in immigration matters not the rep themselves. Like mine is based in washington but she has a person here in my city that does the work for her, they should have offices in your capitol city and maybe again in your largest city also like in okla they are in okla city and tulsa.

Link to Website for Senator Pete Domenici (New Mexico) This is the page for Help with Federal Agencies. It has the locations of all of his offices in various cities in New Mexico. It also has the Privacy Relase Form that you can print and the form includes a place to put all the specifics of your situation.

Pete Domenici's website is a phone number you can call for a 30 minute legal consultation for $30.00. There are other such legal services I've seen on the web where you can have a telephone consultation for a lot less than a ticket overseas......

I've been following your posts and haven't yet understood how you do communicate with your husband. Do you speak in Arabic or French? Maybe sharing that with the Senator or Congressman's representative will help convince them to assist you.

How im so grateful to all of you for helping me in this matter...... i have not been online because i have been in the hospital with my daughter she has been very sick with her asthma its now 4:21 AM Monday morning im waiting for 8AM to come around so i can make an appointment for her to see the doctor.....and also so i can make appointments to see the senators and congressmen...... i do have to make appointments right?? Well im setting an alarm to wake up in time.....i pray 09 is a much better year.....and Lord willing i plan to go see my husband in March which that will make one year that i last visited him.....i dont speak arabic i know like maybe 10 words.....when we communicated in the past he would use all the words he could in English and some that i understood in arabic and he even used some words in spanish..... ill never forget how he tried to explain to me one day that someone that used a horse to help move some of his things to a different garage..... i laugh now as i remember he made the sounds of a horse but by golly i understood what he meant.... we had us a good laugh that day....well my dear friends i need to get a little sleep ill check in with you all as soon as i make those appointments ....God Bless You All....Bernice

yes, call and talk to them, they should send you a form first, i have done all the talking by letter, email and phone, i have never had to go see them but you will find after talking to them what they prefer, they have to learn the details and problems of your case but first you have to give them the authorization form so they can continue for you.

How im so grateful to all of you for helping me in this matter...... i have not been online because i have been in the hospital with my daughter she has been very sick with her asthma its now 4:21 AM Monday morning im waiting for 8AM to come around so i can make an appointment for her to see the doctor.....and also so i can make appointments to see the senators and congressmen...... i do have to make appointments right?? Well im setting an alarm to wake up in time.....i pray 09 is a much better year.....and Lord willing i plan to go see my husband in March which that will make one year that i last visited him.....i dont speak arabic i know like maybe 10 words.....when we communicated in the past he would use all the words he could in English and some that i understood in arabic and he even used some words in spanish..... ill never forget how he tried to explain to me one day that someone that used a horse to help move some of his things to a different garage..... i laugh now as i remember he made the sounds of a horse but by golly i understood what he meant.... we had us a good laugh that day....well my dear friends i need to get a little sleep ill check in with you all as soon as i make those appointments ....God Bless You All....Bernice

I'm sorry to hear this. You don't need any more stress than you already have. Just take one day at a time, and remember to forget everything on Christmas and just enjoy the day the best you can.

Hi Bernice! If I was going thru this situation with casa I would first pick a senator near you and fill out and submit their release form pronto! It takes them at least 3-4 weeks to do anything on your behalf so start right away. Next act like it is still in casa and keep emailing them asking for the pouch # and be really nice in your emails. Ask if there is anything at all you can do to prevent your petition being returned to uscis. If it does end up back at uscis, my congressmans office told me it is best to cancel the petition and start all over with a new one. She said priority is given to the new petitions and alot of times the old ones get wait listed as such. she said your in for the same 6-9 month wait but at least it's only 6-9 mos as opposed to ????????? that was my husband and my plan B. If ours was sent back I would move there and file direct consular or refile a new petition with me staying with him for a few mos. Thank God ours was turned around! It's up to you but I could not wait anymore. Good luck to you.

Hello everyone hope are are doing well.... my daughter is doing better Thank You God..... and i recieved an email from Casa this morning stating that my husband's case was sent back and they even gave me a diplomatic pouch number to trace it.... this does mean they sent it back....so i did get a hold finally of my senator and he is willing to help me the question is now how can he help me if they already sent it back..... i have already made plans for a third visit to see my baby....i plan to stay another month with him......one month is all i can take away from my children and thats all they can handle..... i get so much ####### from their father on how i leave them for so long how can i do that to them.....that they cry to sleep every night missing me.....this hurts me so much but i have to go see my husband....if i dont go then we wont be proving our relationship as we need to...... and i do have some dvds of us together in :star: Morocco....of our wedding of course.....trips we took up there and family moments like us cooking together...... im going to take a lil break not that im giving up.... but its the holidays and i think i have made my family crazy enough these past weeks..... i have really found some true friends and i want to Thank each and everyone who has been helping me get through this difficult time.....i will keep in touch.....Well I wish all of you whom celebrate Christmas a Wonderful holiday full of many blessings and happiness....God Bless You All my dear friends....Bernice :star:

I am glad that your daughter is doing better. That must have been the icing on the cake with everything else you are up against.

I was going over my notes from when ours was returned. I thought it took almost a month but it was almost 2 months. Anyway the purpose was to locate the phone number in Washington to track the diplomatic pouch but I couldn't find it in my notes. I googled it, and I hope this is it, but if it isn't let me know and I will keep looking.

This steve is the best, he is so good but all he can advise you is that yes it has arrived and yes he will forward it on to your location (vermont or calif) . Now once its back, then we need assk what next? mine was a k1 so it was let to expire in calif. The only k3 i know of in Vermont is still waiting and its like 2 years (sorry) so maybe after talking to your rep. to cancel yourself and refile might be the quickest. Also once your case is back there is a number you can get immigration rep that can look into the notes of your case and if they will talk to you a bit on what seemed to be their thoughts or problems, but with mine they werent much help, nothing specific that i could be told so that i could fix it, if i remember all she said was looks like maybe a prob with the interview itself. So when i ask him he said yea he couldnt remember my sons birthday (now is that a reason to deny) heck sometimes i dont even remember it, sometimes i do wonder about these people doing these interviews.

Take a few days for yourself and your family and hit the road again trying to work all this out!

Seriously? The denial was based on forgetting your sons birthday???? Pathetic excuse. You should be getting close, I sure hope this nightmare is over soon. Please keep us informed. The more people that overcome this ####### the better it is for the moral of those going through it.

Thank YOU so much and yes this number worked just fine like you he called me back and i was so surprised because i have called so many numbers from there in Washington and no one but him called me back.....when i gave him that number that Casa emailed me he was like that's not the diplomatic pouch number so he told me to forward the email so i did now im waiting to see what happens.....
