Hi guys... Sorry to trouble you with something that has probably been asked 1000 times... but, we got married in December 12 (on K-1).... just wondering what the deadline is for sending in the AOS package (we'll be sending to Chicago Loxbox). We plan on doing it almost straight away, but I just don't want to get caught off guard and find otu that you had to file within 14 days of marriage or something like that.

You are correct, this is a lame question because it is asked MULTIPLE times every day.

So much so it is the first FAQ in the AOS FAQs http://www.visajourney.com/faq/k1k2visa-aos.html#6.1

You need to marry within the 90 days, and should file AOS as soon as you can, but can do so outside the 90 days without issues.

First of all -- thanks for bearing with my lame question :blush: .. and for answering.... it's much appreciated.

Second -- I hadn't see that part of the FAQ... but I had read the AOS Guide very carefully and multiple times, and couldn't find any deadline information. The guide seemed like the right place to start... maybe we could add the answer to my (admittedly) lame question in the guides as well? That might cut down the number of times the question is asked from 1000 times a day to... oh... 950! :lol:

Firstly, I hope that you got married within 90 days of being admitted to the US.

The deadline to file AOS is not linked your wedding date. However, I strongly recommend that you apply for AOS before your I-94 expires so that you are not staying "out of status" in the US. The notice of action for the I-485 will be the proof of your pending adjustment of status. Keep that document very carefully until you get your conditional green card!

Note that that you will receive the NOA about ten days after mailing your AOS package .. so if you want to play it really safe, send your AOS package at least ten days before your I-94 expires.

Another forum related tip is that you add a timeline to your signature so that it is easier for others to answer your questions.

2008

10 Oct - Arrived in the US on K-1 visa

12 Oct - Legally married! We'll have the ceremony and the reception in Spring '09.

18 Oct - Visited civil surgeon for vaccination records

29 Oct - Mailed I-485 packet to USCIS Chicago lockbox

31 Oct - Packet received by USCIS [Day 1]

06 Nov - NOAs for I-485, I-765 and I-131

14 Nov - Biometrics appointment notice date

19 Nov - I-485 application transferred to CSC

04 Dec - Biometrics appointment [Day 35]

05 Dec - I-485 and I-765 touched [probably attached biometrics info to my records]

2009

05 Jan - EAD card production ordered and AP approval notice sent! Received e-mails from CRIS. [Day 67]

12 Jan - Received EAD card and AP documents. [Day 74]

13 Mar - Received RFE from CSC for I-865 and "missing" medical forms

31 Mar - Response to RFE sent to CSC

23 Apr - I-485 approved! Received e-mail from CRIS. [Day 175]

25 Apr - Received green card, which is not green at all! Done with USCIS for 21 months! [Day 177]

01 Feb - Apply to remove conditions on the temporary permanent resident card.
