So we spoke to an immigration lawyer today, and he confused me! He knows Im coming from Canada, so I qualify for the Visa Waiver Program. He told us that if we were to decide to marry while in the states, I wouldnt have to come back to Canada, and he can file on our behalf to have me stay there for good. I let him know I use the VWP, I dont get B2's, and he said you don't need a B2, that I can come in under the VWP.

How on Earth can he do that?

I told him everything Ive read, Ive read other-wise, and he just said "trust me.. it can be done"/

I wonder whats up with that?!

He aint a very good lawyer if he told you that you can marry while you enter on the VWP. 1 it's fraud if you have the intent to marry while you enter the USA. I would phone another lawyer or do it yourself.

Well, he has a very important fact wrong... Canadians don't need to be in the VWP to travel to the US. So, that to me just points to stupidity. I have had a stamp stating B2 in my passport, but I don't get it everytime. I think they just stamp it when they feel like it.

Secondly, you can do what he is stating, BUT and this is a big BUT.... if your INTENT is to marry when you cross the border and you are caught in that lie, you are comitting immigration fraud. You must be able to prove that your intent was just to visit and that you meant to get back.

The sheer fact that you are considering filing for a K1, already kind of denotes that you have intent. But that's your risk to take....

I personally would rather stick out the K1 for the 8-9 months that it takes and just do it the right way. I'm waiting for an interview and the whole process has flown by.

Just to clarify, they can get married but if she had intent to immigrate and stays then it is fraud.

The marriage in and of itself does not constitute fraud.

Canadians travel under a unique agreement, not the VWP. That aside, the details of the circumstances including the timing of decisions will determine what can and cannot be accompished. I'd listen to your attorney, if I were in your shoes. He's the one who asks you all the questions you wouldn't want to disclose here.

No, were filing for a K1. I just thought it was odd that he would ask why we are applying for a K1 when it could be easier to just come down, get married and apply for perm residency after.

believe me it's better to do it without lawyer

our lawyer coast us 1700$ and he didn't do anything except take our money

he dotn even answer our calls
