timelines for marrying a F1 student visa???

Timeline

My wife came to Atlanta for school in mid-April. We met at my church, dated, then got married on Nov. 22. However, she finished school on Oct. 17. She was taking English classes and was going to transfer to a degree program. Her English school told her she had 60 days to transfer, but we got married within that 60 days. Also, we sent in the AOS on Dec. 13 (before that 60 day window to transfer). Also note: since we got married we made a financial decison to take a break from school. My understaing of her F1 student VISA is that she can stay here as long as she's going to school. So, I'm waiting to hear back from USCIS on the approval, but i just wanted to see if anyone could tell me if we're ok. I know if they approve the application then she'll be I-45 status pending, and she'll be good to stay here. Thanks in advance for your replies.

Once AOS is pending she can remain as long as it takes for USCIS t make a decision on the I-485.

You did file an I-130 along with the I-485.

Lastly, keep in mind AP is required to be able to travel while AOS is pending, even though the F-1 may be valid and is multi-entry, AP is still required to travel out of the USA and return. Doing so without AP is ABANDONING the AOS.

To file for AP simply file an I-131 to the Chicago PO BOX and include a copy of I-485 NOA1 receipt letter.

I know that you keep F-1 as long as you are approved for I-485, but what if you are not approved. then can you go back to F-1 and stay in college??

7/12 - Sent I-751 Package by USPS

7/15 - Package was delivered at 11am

7/15 - Date of NOA

7/19 - Check was cashed

7/19 - NOA letter was received

7/28 - Biometrics letter received, date- 8/23/2011

8/01 - Early Biometric was done

11/15 - Card Production ordered

11/19 - 10 years Green Card arrived.

If you plan on travel while AOS is pending then file an I-131 for AP document, attach a copy of I-485 NOA1 letter to the I-131 their is NO fee when AP is based on a pending I-485.

F-1 cannot travel while AOS is pending without AP document.

Not an expert but these are my thoughts:

Once you file for AOS her F-1 status is gone and won't be coming back. If you're somehow denied she will have to leave and reapply.

Again, this is just my 2 cents and not an expert opinion. :)

7/928 2008 - Mailed packet (I-130, I-485 & I-765)

7/31 2008 - Packet arrives at the Chicago lockbox

8/07 2008 - Checks cashed

8/08 2008 - NOA Received (I-130 & I-485)

8/08 2008 - Application Rejection Letter received for I-765 (Outdated form that expires 08/31/08!!!)

8/11 2008 - Biometrics Notification for August 28th

8/14 2008 - New I-765 received by V. Bustamente

8/18 2008 - Tried a walk-in Biometrics but office closed(!!)

8/19 2008 - CRIS email. RFE #1

8/23 2008 - RFE Letter. Birth Certificate (wth?!?)

9/09 2008 - NOA for I-765 received

9/12 2008 - EAD Biometrics notice for 9/29

9/16 2008 - CRIS email. RFE received on 9/11 and case resumed.

9/26 2008 - EAD Biometrics completed and touched online.

11/07 2008 - EAD Card production ordered.

11/08 2008 - Interview Notice for December 09th.

11/20 2008 - EAD arrived in mailbox and work resumed.

12/09 2008 - Interview. AOS approved and card production ordered.

12/10 2008 - AOS Touched.

12/12 2008 - AOS Touched again.

12/15 2008 - AOS Touched a third time (which usually means the card is in the mail! Hurray!)

I really wouldn't know because even after I got my green card, the Office of International Programs wasn't advised I wasn't an F-1 anymore.

05/01/08 Green Card in mailbox!!

06/05/10 Real GREEN Card RECEIVED!

01/17/13 Sent application for US Citizenship!!!

01/19/13 Arrived to Arizona Lockbox

01/24/13 Notice of Action

01/25/13 Check cashed

01/28/13 NOA received by mail and biometrics letter mailed as per uscis.gov

02/14/13 Biometrics appointment

03/18/13 In-line for inteview
