Expedite when outside of processing time?

Good Morning VJ!

Today marks 6 months since receiving our NOA1 for the I-130 petition. We've read on various posts that couples can file an expedite if they're 6 or 7 months outside to processing times??? Is this correct? Does that apply to the I-130 or the I-129F?

Any assistance/advice is appreciated, thanks so much....

I haven't heard of such thing. As far as I know, based on what I've seen, expedites are only given out for medical emergencies and people in the military. But they're also not easy to come by either.

Believe it or not six months is still within the average wait times, I've seen people wait close to a year depending on the service center.

You not outside the processing time, you can check the timeline, its Febr/March 2008 för a I 129 and I 130, its still people in March who wait on a approval.

Sorry to say, but it won't work. There are as mentioned certain criteria that can get an expedite anything else is a no go. They are strict on this. Based on their timeline you technically are not outside normal processing. There are still a lot of march filers and maybe a few february ones left waiting. From uscis website:

USCIS Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The criteria are as follows:

Severe financial loss to company or individual

Extreme emergent situation

Humanitarian situation

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

Compelling interest of USCIS
