My husband was originally in the U.S. as a refugee from Palestine. We married 4 years ago but never filed a petition to change his status because we were young and broke and our babies came along quite quickly and since he had work authorization it was a non-priority to us. He left september 07 without advance parolle due to a family emergency. I finally was able to afford his papers in February and filed 129 and 130 trying to ge a k-3 visa. He was approved in April for 129 and then 130 in May but wasn't able to get his papers and interview until August 1st. In his interview(which was supposed to be for 129) he is told everything is good, gave him back our vital records(birth certificate, marriage cert, ect. and he will get his passport back in two weeks. After 2 weeks we start calling and all they can say is he's in "Administrative processing." Through the course of several phone calls and emails, I still have yet to get any answer as to what this is. Even when I threatened to bring a complaint to the department of state, I got a phone call from the head of the visa unit and he wouldn't even give me a hint as to what the heck they are doing. Can someone here please explain if this is standard security or what? I don't understand how they can tell my husband 2 weeks and then not give any explanation what's going on. They have already cleared him once, he lived here for 7 years, speaks fluent english, worked legally and paid taxes, it's his first marriage, we have 2 children under 4 years old, and has never been convicted of any criminal offenses and yet he leaves for 4 months and now he is a terrorist? Sorry if I seem overly emotional it's just so hard because our boys are so little and they can't understand why they can't see their daddy and at his point I can't understand it either. Does anyone know of somewhere you can try to expedite administraive processing or have the case reviewed to make sure its being handled properly. Is there anything we can do as far as apllying for a humanitarian waiver? Proir to this all happening I was a housewife because the cost of daycare on these 2 cancels out the benefit of working since I have no work experience and only a high school diploma. In the time my husband has been gone we've been homeless twice and are now living with an emotionally instable, alcoholic, verbally abusive relative. Not trying to be a sob story, reading here we've all got them, but I'm just hoping you veterans know of somewhere to turn. Any help would be greatly appreciated. May Allah bless you all!

I am really sorry to hear this happening to you especially as you were ill-prepared and didn't see this coming.

For all I know, Administrative Processing happens regularly either on the 1. stage waiting for the petitions approval or even at the embassy stage which happened to you and your husband. AP regularly happens if your name (do you have a very common name?), for example, caused a hit in one of the databases (somebody who is wanted by the FBI, terrorists, criminals and such) and thus has to be solved before the process can advance. AP can take as little as 2 weeks but can also take several months or even years while USCIS won't ever tell you anything more than "you are in AP".

I am sorry that I cannot give you any better news. Maybe there is a waiver available for your case due to extreme hardship but you need to look into that or wait for these experts here.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

There are many combinations of security checks. More intense for some than for others. Ive seen them listed as to what agency provides the checks and what databases are involved. I think what country determines the intensity of the checks, and I would imagine that Palestine would right there at the top.

Of course they are not going to divulge specifics as many of the checks are done at FBI, CIA, Stte Dept, and foreign levels and involves foreign intelligence sources

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Hello End,

Ap is just another way of saying that they are touching up the paperwork. My husband was in AP for 6 months. They were verifying his documentations and did a home visit to make sure he did not have wife and kids. Wow talk about a great backround check. A little expensive though.

You country is typical for AP. Although it could take 2 weeks to over a year. I wish you an expidited AP.
