Timeline

Here is my short sad story...

K-1 early 2007, approval in may, interview in august6 2007

on interview my fiancee received 221G

exchanging of Email letters finally respond that our case was returned to USCIS for futher review

I went to Armenia and marry my love in September 2007, sent I-130 immediately.

01-07-2008 CR-1 received and pending, K-3 received 02-04-2008

Background check start 08-16-2008

Received NOID 11-26-2008 (with CO notes based on K-1 interview suspecting us on fraud)

Sent respond to NOID with lots of supporting letters,copies of e-mail, phone logs, money transfers, parcels etc

DHS received 12-8-2008

And today 12-16-2008 they I got "denial notice sent"

I will not describe how we are suffer, you all know that

What I can do now , and what to expect ?

Visa Approved :2008-01-07

Consulate Received : 2008-01-14

Interview Date : 2008-06-02

Visa Received : 2008-06-12

US Entry : 2008-06-26

Marriage : 2008-08-02

Total days from filling 1-129F till Interview 270days

AOS TIMELINE

Sept 12, 2008- Sent AOS/EAD/AP to Chicago (finally)

Sept 15, 2008- Delivered

Sept 18, 2008- Noas AOS/EAD/AP (yaay!!)

Oct 7th 2008- Case transferred to CSC

Oct 15, 2008- Biometric APPT (smooth and quick)

Oct 16, 2008- Case pending ......

Update....

EAD Card production ordered ........ 12/03/2008

Ap approved...approval notice sent 12/03/2008

Ap arrives in mail... dated ..............12/12/2008

EAD approval mail sent ..................12/11/2008

EAD arrives in mail ........................12/15/2008

AOS Touched .................................01/12/2009

AOS card production ordered...........02/27/2009

ROC TIMELINE 2011.

Jan 1st 2011 mailed in I751

Feb 15th 2011 Biometric appointment

May 24th 2011 Petition Approved

May 25th 2011 Card production ordered

Timeline

USC should get a lawyer. The lawyer will request in writing reason for denial and supporting evidence. Then you can go from there. Only a lawyer can efficiently and in an expedited way help you now. Good luck!

There are two really good attorneys that do cheap or free consults and have a ton of experience:

www.humanrightsattorney.com

If they don't have a lot of "revocation" experience they are both dependable and honest enough to refer you to someone who does.

If you google "k1 petition revocation" you will find several attorney sites that specialize in this. . .some of the articles in the first link are written by attornies who specialize in this type of case.

It is going to be a long/hard battle, but you are going to need a good attorney and your elected officials on your side, and lots of proof.

I am almost in the same situation. My k-1 visa was also refused and petition sent back for review. I also married and filed another I-130 petition. You have been to the Georgian Embassy, right ? I think they never approve K-1 visas there....

My k-1 petition has not been revoked by USCIS yet.

So your new petiton is pending ?

Unfortunately this is why it is wise to wait for something from the USCIS about the K-1 before you refile. They normally expire, but it is up to the discretion of the service center.

What happened to the NOIR for the K-1? Did you respond? Did they send you a NOID for the I-130? I am not sure I have the facts straight.

I know of a lawyer that is extremely versed in denials. If you would like I can get you the contact information for him.

Oh yes, for the record. My husband was denied the CR1 visa, and it was sent back to the USCIS. When we received the NOIR I sent in our proof and it was reaffirmed. He got the visa and has been here 2 years now.

Yours is a little different than ours, and the fact that you married and filed before a decision was made on the K-1 puts a glitch in it. Hang in there and fight.
