oh ok so use india address for both mailing and residence address then.

In terms of proving domicile we are thinking of attaching :

1. Bank statements from a couple of bank accounts

2. Tax returns are attached showing address as US.

Will both these things be enough ?

I think it's better if you can provide more.

Does your wife have a current US driver's license?

Is she moving back for work/school? If school can you provide a copy of her acceptance letter?

Also she needs to show arrangements of relinquishing her residence abroad

i.e. selling off assets

transferring money back to her US account/s

She's just lived in india since May 2008 - like 7 months. Yeah she has US drivers license and SSN too.

one last question hopefully...haha...look where did i start this topic and where it has come...

Do you know in what format the written explanation for domicile needs to be in? A letter ?? Addressed to whom ?? or does it need to be like a TO WHOMSOVER IT MAY CONCERN kinda letter ???

Yes, just to who it may concern is fine.

Then just an explanation that your wife is really just in India temporarily, awaiting your visa before you two move back together, then a point by point list of what you are including to prove domicile:

- Copy of current U.S. driver's license

- Copy of latest U.S. bank account statement

etc etc

Here is our letter, you might find it useful to use a similar style

Dear Sir/Madam,

RE: I-864, Affidavit of Support – No. 15 Country of Domicile

Case Number: SYD2008xxxxxx

I, <name of petitioner>, am currently residing in Australia however my country of domicile is the United States. I have maintained domicile with the US through:

1. Proof of maintaining bank accounts in the United States

2. Proof of having a permanent mailing address in the United States

3. Proof of current Washington state driver’s license.

I have also taken the following steps to re-establish my domicile further by:

4. Graduate school acceptance letter from <university name>

5. Housing application form submitted 24 June 2008

6. Arrangements to relinquish residence abroad

Please find attached documentary proof of the above conditions.
