My DIL just arrived on a K-3 visa and is applying for her EAD. She already has a SSN from the time she was here in 2006 on a J-1 visa. Since K-3 visa holders do not normally qualify for a SSN, do we need to enclose a copy of her old J-1 visa?

We did put her SSN on the application form and did mention why she has it in the cover letter. She doesn't actually have the card, as she threw it away, thinking she would never need it again.

Both the USCIS and Dept of State reps told me that on line 11, where it asks about former USCIS employment authorization, to put "no" since the summer work study program is entirely handled through the Dept. of State and bypasses the USCIS.

If it doesn't warm up here, she might not want to stay until she is allowed to work! I would not blame her one bit.

Perhaps we should all vacation in Thailand.

SSNs don't expire, so if any form asks for an SSN, just use it. Don't think there is any need to explain why she already has an SSN, since a lot of people such as her have been here before and were assigned an SSN.

Since she has an SSN, she can go to any SSA office and request an SSN Verification Printout. Not the same as having a card, but better than nothing for the time being.

We went to our SSA office today. They gave her a print out verification of her SSN, but are not able to put her name change in the system until she gets her EAD. It just feels good to have that piece of paper proving her number. He said she could use it along with her marriage certificate. The gentleman was very nice and the wait was short.

You up for another trip to the SSa office? LOL This one you might need to speak to a manager, but if they can read they will see you are right.

4. Correcting Numident Data When a Replacement Card Cannot Be Issued

If the alien does not provide evidence of work authorization or a valid nonwork reason, explain that no replacement card can be issued.

Although a replacement card cannot be issued, the Numident can be corrected if the alien has provided documentation supporting the change (e.g., a name change).

Once the record has been corrected you ask for another Printout. Then when she has an EAD card she only needs to apply for a replacement card, since the SSN record has already been corrected.
