Hi everyone,

I moved to Houston, TX in august this year on a K1 visa, and got married on the 19th of october, i sent all the AOS paperwork, and now im just curious, can i get an ID card without having the I-94 because it expired in early november?

As of right now i have no proof of identity since my german passport has my old name and adress in it, and i dont have a drivers license either so all i have now is a social security card wiht my old name on it but they changed it in their system they just cant issue me a new card yet cause i need my green card for that. I cant even get a bank card to our bank account because i have no proof of id. however the social security officer told me that i can get an id card with only my social security card and passport and marriage certificate. so i went to the local dmv office here and they told me no because my I-94 is expired and i have to wait for my green card to get an id...which can take months or even a year or who knows even longer so what am i suppose to do i dont want to walk around here without having any proof of id whatsoever.

i cant even get a new german passport while im here because they need my green card as well to make sure im a permanent resident here

im really frustrated!!!and dont know what to do anymore! i feel like im non existing!

i hope somebody can help me out with this!!

You will need EAD or green-card to get a state ID card, TX requires evidence of legal status.

You can get the SSN card changed after getting EAD or Green-card.

File for EAD when you file AOS, base EAD on pending I-485 (C )(9 )

Hi, I just thought I could share my experience, because I'm also located in Houston, TX.

My SSN card has my old name on it. Same thing, they would not change it before I can show them my Green Card, so no joint bank account for me either. :unsure: This goes for the driver's license also, I still don't have one. The only ID I have now is my passport, with my old name on it. But after my marriage, I went down to the Brazilian Consulate with my marriage certificate and had them stamp my passport with my new married name. Maybe the German Embassy might have something similar, I would not know.

But even with all that, there is very little you can do.

As YuandDan said, once you get your EAD, you will then have some sort of ID in your married name.

That's a real situation you have there. Maybe you take comfort in the idea that even if you had applied for a DL in Texas before your I-94 expired - which I assume means that your K-1 expired, your DL by now would have expired as well as your K-1 visa as they usually issue DLs for non-citizens with the expiration date of their visas or Greencards. The name change though would be provable showing your marriage license and your marriage certificate. Anyway, DMV or MVD (however they are called in Houston) won't issue a DL unless you have a valid visa or Greencard. I think the EAD or the Adavnce Parole for Travel could do although I think the EAD would be better as it is more what they would expect to see at MVD.

I applied for all the additional stuff (EAD and Adavnce Parole) when I applied for Adjustment of Status and the EAD was what arrived first after just a couple of weeks (76 days after filing). So, I suggest you make sure you've applied for the Work Authorization (I-765) and do so if you didn't already do it. Then after a couple of weeks you get an EAD that's valid for a year and can be extended if your Adjustment of Status would be still pending.

The German passport should be easy to fix. You have a valid passport and you have a marriage license/certificate that shows your name change and I don't see why the Embassy would have a requirement to see an actual Greencard to issue you a new one. If you have the NOA1 receipt notioce of your I-485 application, then this should be enough proof that you're in the adjustment process and your case is pending which also tells them that you can't leave the country to get a passport in Germany at this time.

thank you for your quick reply!! i have to go back to get my fingerprints taken again cause the FBI was unable to process my fingerprints the first time ....for some weird reason. so as of right now the whole process is being stopped until they get the new fingerprints and i hope i get my EAD soon so i can finally start having a life again.

thank you precious its good to hear what kind of experience other people with the same situation in the same city went through i hope things work out for you soon as well

Er, I'd contact the Embassy myself on that one. I know otherwise from my husband just having done this that you have to apply in person. You have to provide proof that you unregistered yourself from wherever you last lived in Germany which is required when you move out of the country anyway (abmeldungsbescheinigung). You have to have a green card. The embassy site is down now, but I'd seriously check with them first if your passport is expired.

No example of what that would be is given, but it is possible without a green card. I'd call and ask to be sure you have what they would take.

The German embassy even accepts an expired K-1, along with your NOA1 for AOS. I did it the same way in Houston, and had NO problems whatsoever.

For the bank: they have to accept your old passport, along with a certified copy of / the original marriage license. That even suffices wenn you are traveling into the US with an AP - I don't see why a bank would not accept it.
