okay. so I waited about an hour to talk to customer represtative over the phone

and I told my situation(never received my NOA1s, assume my received date was March 12th...blhablahblah)

she was pretty nice and she transfered me to her supervior or someone knows about interm EAD

and she said go ahead make an infopass and take my biometrics appt letter and post office receipt says it was received on march 12th and my ID.

she also said, they might not give you intermEAD but I can try...

so I was like Yeah! that's all I want, just try!

so I went to USCIS.GOV

put my zip, chose over 90days..you know that option

and it says

"At this time, there are no information appointments available for the office in your area. Please try back again later. "

WHAT THE@!!@

if my received date was March 12th, and my 91day will be June 13th which is next monday.

and there are no information appointments!! has anyone got this message before?

what should I do?

my DO is in denver, and it looks like I don't have any luck. :crying:

Hi,

My DO is Denver and I've found that by checking on a day to day basis there seem to be only a couple of interview dates available each time. But, when there are dates available they are usually in following week or 2.

So, just keep trying each diff times each day. Good luck.

Also, find a post by LaGreenEyes regarding a 2nd infopass appointment to get an interim EAD. It was recently on either the AOS forum or working and travelling prior to getting GC. I'm pretty sure that on the post it has a link on there to the "law" that is posted on the USCIS website that states about them having to issue you with an interim after 90 days etc. You should for sure print that out when you go.

Anyone else remember that???

THANKS A LOT FOR YOUR REPLY.

I just tried again and it worked but only available date was 8th which is this Thursday.

They didn't have anything available next week. and my 91days will be next monday.

I will keep trying and I will print out those law pages for sure as well.

I've searched LaGreenEyes's post but couldn't find a link for that law.

anyone knows?

Hello! If you look on the USCIS.gov website under the Q and A section there is a whole set of instructions about EAD and it says in 2 places about the 90 days. I also printed out the info pages about the National Benefits Center (MSC) and it is also stated in those pages. Try for the infopass appts after midnight eastern time, that's when they seem to get released into the system.

from federal law...

" Interim employment authorization. The district director shall adjudicate the application within 90 days from the date of receipt of the application by the INS,"

8CFR274a.13

And here is the topic: http://www.visajourney.com/forums/index.php?showtopic=16162

I printed the I-765 instructions (to bring with me for the infopass, IF I need) where it says:

"Interim EAD: an EAD issued to an eligible applicant when USCIS has failed to adjudicate an application within 90 days of receipt of a properly filed EAD application or within 30 days of a properly filed initial EAD application based on an asylum application filed on or after January 4, 1995. The interim EAD will be granted for a period not to exceed 240 days and is subject to the conditions noted on the document."

Good luck and let us know how it went...
