HI VJ FAMILY,

I APPLY MY DAUGHTER FOR A VISITOR VISA, WILL SHE BE APPROVE FOR THAT? BECAUSE MINE IS CR-1 VISA. I AM GONNA HAVE INTERVIEW BY THIS WEEK AND HERS TOO. I AM WORRIED THAT SHE WILL NOT GRANTED FOR THAT KIND OF VISA. SHES MY DAUGHTER AND SHE IS 9 MONTHS OLD. HER STEP DAD IN US IS LIKE HER REAL DADDY. HER DAD WANTS TO SEE HER OR BRING WITH ME TO GO TO US. SINCE WE ARE NOT FILLING HER FOR AN IMMIGRANT VISA. THATS WHY I AM CONFUSE AND WORRIED ON HER SITUATION. WE NEED TO BE THERE URGENT.

I dont think you will be able to get her/him a visitor visa. Why did your husband not apply for a cr2 visa for your child? This sounds like a real winner you have there.

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

I dont think you will be able to get her/him a visitor visa. Why did your husband not apply for a cr2 visa for your child? This sounds like a real winner you have there.

its because we thought that she can get a US passport. my husband is not her biological father. we only thought she can get a us passport so my husband dont think to get her cr2 visa. but my daughter got denied for us passport for shes not applicable for a derivative us citizen. thats why i am worried for her. its not easy to leave my baby who is 9 months old here in pinas

This is definitely not going to work. I'd say no chance at all. The child will need its own I-130 filed by the step-father. What an unfortunate mistake in preparation. Unless you are comfortable leaving the child behind for several months, I'd get that I-130 filed and delay your CR1 interview.

PLS ADVICE

How far along in the CR-1 process are you (you need to fill in your timeline)? If your not yet to the interview stage, then it ma be possible for your husband to file a 129F and proceed with a K-3 visa. Your daughter would get a K-4 visa (derivative status) during the same interview. This would then require AOS in the USA (plus the filing of a I-130 for your daughter). It would be more expensive, but might be faster depending on the current status of your CR-1. I am not sure at what point in the process would be too far along to switch over to the K-3/K-4 route. Please tell us your timeline and perhaps more exact advise can be offered.

definately what i would do also. There is no way in h*ll i would be able to leave my child behind.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

definately what i would do also. There is no way in h*ll i would be able to leave my child behind.

one thing i donot understand is why she cannot get a visitor visa. i am asking a visitor visa for her. she can go back here in philippines whatever the consul will give her how long she must stay there. her dad wants to see her there. my husband is a cancer survivor. she wants to see my baby. she treats my baby as his real daughter. but at this time i will be having interview and her is interview for visitor visa.
