We have not yet received our NOA2 yet, but I expect to hear something by March 2009. I will be going to Peru to visit my fiancee in January. I want to help her to be ready to prepare her forms and backup. Here are my questions:

1) Question # 34 on the DS-230 form asks if anyone assisted the fiancee in completing this application. Is it important that my name goes in there? If so, will that be a negative "red flag" of some sort?

2) She has a 7-year old daughter. Does she need to fill out both the DS-230 Part I and DS-230 Part II for her daughter?

for your first question: yes if she's beeing assisted by you then you should put your name on it and no it is not a red flag at all, specially if the fiancee is the one helping. now for the other question, has she filed a separate I-130 for the daughter first?

Timeline:

filed I-130: 2007/10/10 (child under 21 unmarried of a USC) "IR2"

uscis sends NOA: 2007/10/22

21st b-day: 2008/**/** (well that sucks)

I-130 approval notice: 2008/06/15 (was approved due to CHILD STATUS PROTECTION ACT, signed by Pres. Bush on August 6,2002)

case forwarded to NVC: 2008/06/16

biometrics bill received: 2008/07/13

biometrics bill paid: 2008/07/15

IV bill received: 2008/07/27

affidavit of support request received: 2008/08/02

affidavit of support request sent: 2008/09/20

IV bill paid: 2008/09/20

DS-230 request received: 2008/10/01

DS-230 request sent via express mail: 2008/11/20 (had to wait a loooong time for police certificates)

NVC receives DS-230 package: 2008/11/29

CASE COMPLETE!! : 2008/12/09 (no RFE)

I don't think u have to put your name there...I think is reserved for agency (like lawyers) that take care of your paperworks

2) She has a 7-year old daughter. Does she need to fill out both the DS-230 Part I and DS-230 Part II for her daughter?

I think that for her daugher (if she will come to the USA with her mum) she will need to fill up just form DS 156

I also wanted to correct my other answer about putting your name on question 34.

I read it better and i think you DO wanna put your name there and I DO NOT think it will be a red flag!

Under the VisaJourney Guide for K1/K2 Visa Applications, answer to FAQs 4.3.1, it says "Fill out and sign the DS-230 Part 1 biographical data sheet and send it back to the Consulate, one for the fiancee and one for each K2 child." However, this does not make a whole lot of sense to me.

You will need to look at your packet 3...on mine they wrote that just for form DS 156...Also on form DS230 they will already ask what childern will accompany her to USA (question 21b)....

Here an example of what my packet 3 say:

FIRST: Complete the enclosed Form DS-230, Part 1, Application for Immigrant Visa and Alien Registration, and send it via fax to (39) (081) 583-8394 or send the original Part I via mail to Consolato Generale Americano, Piazza della Repubblica, 80122 Napoli, Italy. We recommend that you fax us the DS-230, Part I, because it is both more reliable and faster, and keep the original DS-230, Parts I and II, for presentation at the time of the visa interview. The Consulate cannot process your case until it receives this form.

SECOND: Fill out but do not sign the enclosed forms: (1) DS-156 Nonimmigrant Visa Application (in duplicate); you must also complete two copies of the DS-156 for each child who will apply with you; and (2) DS-156K Nonimmigrant Fiance(e) Visa Application.

These are the instruction on my packet 3...you may wanna check out the instruction of your packet 3 (usually u can find it at the her embassy website)

You're right it'a K type visa so... Now as far as the child you DO need to fill one out for the child, it says so on the very first page of the DS-230. Instructions: Complete one copy of this form for yourself and each member of your family, regardless of age, who will immigrate with you. Please

I see that you are correct! When I first read that statement, I misinterpreted it to mean that she should fill out ONE copy that would include herself AND her kid. Now I see that it means one for her and one for each kid. Thanks!

There is no need to put your name as having assisted. You can but it is not needed.

The K2 applicant provides all the same visa applications to the Consulate as their K1 parent.

Facts are cheap...knowing how to use them is precious...
