My wife and I submitted sent her I-751 to Vermont about 2-3 weeks before the end of her 2 yr Green Card. I don't know where my mind was when I was putting everything together, but I forgot two big things.

1. Passport photos

2. Filing fee

What's going to happen now? My wife and I have been married for over four years. And we have a four month old son. Both my son and I are USC's.

Do we need to get a lawyer and get ready for a fight, or is this something that can be fixed?

I think they may just send the whole package back to you and tell you to pay first and foremost, some one else may be able to clarify a little better.

Usually without payment, the whole thing is sent back to you. Don't know if it would be any different for an I-751.

There are others here who have neglected the photos; check a few threads down the list.

When the documents come back we'll of course add the payment and the photos. But my real concern is what does this mean for my wife's status in the US? By the time the documents come back and we resubmit, her 2 yr Green Card will have expired.

The late filing can be forgiven, and you should be able to document that a filing was made prior to the required deadline albeit a defective filing that had to be re-filed and was remedied and refiled promptly.

I agree with Yodrak. When you do resubmit including copies of your mailing receipts and a note of explanation would probably not hurt.

Here's an update of where we are with this.

Got our papers back yesterday along with a blue paper (I-797) informing us that our documents cannot be processed due to the missing fee. But the paper doesn't say anything about the photos.

So, should I include photos anyway with the fee?

Maybe I'll throw them in, just in case.

of course, you should submit everything that is required for the removal of conditions.

also including a note of explanation & your original notice receipts won't hurt (as recommended by yod & meaux).

Throw the photos in if you can. Be prepared to have to take yet another set iin to order your new card at approval time. Others have reported that this happened to them.

One step at a time... seems these I-751s are different at every Service Center now.
