hello everyone , my husband who is a US Citizen would like to petition my 2 sons in the philippines, what does he needs to do first? and how much income does he needs to make? can i support my income too ? or can my sister whos also a USC can support her income ? i know that 125% of my husbands income is required and his income is only 24,000.00 a year is this enough to support

my sons application ? pls we need ur help ..... thanks and happy holidays!...jessica

Firstly step children need to be less than age 18 at the time of marriage for step parent to be able to file I-130's for them.

At this point income does not matter to file the I-130. Income comes into play when NVC sends out the I-864 fee bill for the visas, at that time you need to provide an I-864 for each immigrant and need to satisfy the income requirement for a family of 4. Currently 26,500 (AK, and HI are MORE) GROSS income before tax.

You can add your income to that of your husband by providing an I-864A as a member of household.
