Hi,

We are going with K-3. Does my husband has to pay any fee in the state? He'll send me such Affidavit form etc.. Does he need to do anything else? Thank you so much!

The DS-3032 only applies if you're pursuing a CR-1 visa, not to a K-3 visa.

DS-3032 form is sent by the NVC to the beneficiary to ask them whom they would like the NVC to send correspondence and bills to. In this form, the beneficiary can designate another person as their agent, the person who they would like to receive all NVC bills and correspondence. If you are the petitioner in the USA, it is preferable that all communication go to you instead of the person you're applying for in another country. So all the beneficiary needs to do is fill out the form with their information, provide the address of the petitioner, and sign it.

The beneficiary should send the signed form to you, and then you should forward it to the NVC. The NVC will not generate the bill for the Immigrant Visa package until they receive the DS-3032.

If you have a lawyer already on your case, they are by default your agent so a DS-3032 does not apply. The DS-3032 only applies if you do not have a lawyer.

DS-3032 also does not apply for K-3 visa because the I-129F is being sent to the Consulate directly, and they will be sending correspondence to the beneficiary as they're in the same country and it's not preferable to be sending things to the person in the US.

I do not believe there is anything left to be paid in the US. Any applicable fees going forward would be paid in the beneficiaries country.

The specific fees might depend on each Consulate. I can only talk about the Mumbai Consulate, to which I need to pay a fee of $131. This does not included any fees associated with the Medical and courier fees for submitting documents. I suggest you all check the website of your respective consulates to get more information.

For everyone, please be sure you weigh the decision of K-3 versus CR-1. The K-3 will likely give you a quicker interview, but once your spouse comes here there's further processing needed to adjust your spouses status so that they can get a Green Cards, employment authorization and SSN, need to wait until 2 year anniversary of your marriage I believe, not to mention almost $1000 in fees to get all this done. If your spouse comes on a CR-1, they will be able to get the three almost immediately or within a few months. Yes the wait for the interview might be longer, but you'll have better overall experience. I for one and many on this site originally planned to pursue K-3, not understanding the implications of it, and after getting enlightened, decided to pursue CR-1. So please think it over. Many of us are trying a hybrid strategy, instead looking to pursue both tracks. In this way we get the quicker interview from K-3, use the NVC shotcuts like LingChe's to make the CR-1 process faster, and then get the K-3 interview changed to a CR-1 interview once the Consulate received the CR-1 packages. I would also suggest you make sure that you can convert the K-3 to CR-1 to make sure it's possible in your country's.

I'm not sure about India, but you are already paying the $400 IV bill in the U.S. so there should not be any charge at the embassy.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
