I'm new to visa journey - even though I already have my permanent resident card.

I have my Green Card (permanent status) and have been offered a job by a previous employer of mine.

They would like me to work remotely for them. Can I be a sole proprietor of my own business, be a resident of the USA (I am still a citizen of Canada), and work for a company remotely & on-site in Canada as well?

Has anyone done this before? If so, any direction would be appreciated. Can I open up a business name in Canada or do I open a business in the USA?

It seems you are muddling the terms "sole proprietor" and "employee" youcan't be both within the same association. If you establish a business of your own, there's nothing to preclude you from having international clients. Further, as far as I know there's nothing that would prohibit your company from providing services to another company in Canada.

As a LPR (green card holder) you have all the rights of a citizen except for voting and holding a few specific jobs - go ahead and be a sole proprietor or LLP or whatever your heart desires. Good Luck

There isn't a lot of detailed info here. I agree that there seems to be a generous mix of employee and business owner. I also agree that you have most of the rights as any US citizen. Just be careful here. Many times people do these shifty business arrangements to avoid paying taxes. Make sure anything you are doing is straight up with the IRS.

You only thought the USCIS had power. The IRS is probably even more powerful. You do not want to start bending their laws.

Taxes, that poses another question. If the business is incorporated in Canada, then wouldn't it be subject to Canadian taxes? And if that business is employing you and paying you in the USA, then you will be subject to US taxes.

Sounds like a tricky arrangement to me. Might be better to incorporate in the US. At least that way you've got everything (IRS, lawyer, accountant, etc) within easy reach if you run into technicalities.
