hello

this is my first post here on this forum. my question is concerning the children of my future spouse. i met and fell in love with a wonderful woman in july of 07. she has two beautiful daughters ages ranging from 3 to 7 years old. my question is concerning which addtional forms that may be necessary to file for her children so that they may accompany her to the US at the same time. is this possible? or will the children have to wait until after we are married?

If you marry in PI.

The way things are now your best bet will be to file I-130s for each of them. Mom and kids will get CR-1/ CR-2 immigrant visas. May be a a little longer but cheaper and MUCH better than Nonimmigrant K visas in the long run. Saves the cost and hassel of having to adjust status.

Have moms start getting the NSO documents and passports. I recommend at least 3 certified copies of the NSO documents.

If you don't martry in PI then you'll have to do K1/K2 visas [Fiancee]. File a single I-129F and include the kids names. Still need same documents and PP.

I think the OP is looking at the Fiance/e Visa (K1/K2).

gearman - if you are filing for petition for an alien fiancee you may go the K1 route,while your fiancee's kids will have a derivative visa K2. Once it gets approved, they may go together. Read the guidelines on K1 for more info here in VJ and you may go to www.uscis.gov

I-130 for Parents (Mom and Dad)

3.15.2014: Mailed I-130 Packet for Mom and Dad

3.21.2014: Received email notification with case # for both petitions; case forwarded to NBC for processing

3.21.2014: Check cashed

3.22.2014: Hard copy NOA1 received

4.08.2014: Both I-130 approved (notification received via email) - It only took three weeks!!!

4.11.2014: Received NOA2 approval notice in the mail.

5.01.2014: Called NVC to ask for status of paperwork. Advised they received both application on 4.28. Advised to call in 30 business days for an update.

6.02.2014: Email notification received from NVC that shows parents' NVC case number and instructions to pay AOS Fee and fill out DS 261.

6.03.2014: Paid AOS fee ($88 for both petitions)

If you are planning to get married in the US then you'll be applying K1 (1-129f)and the 2 kids will be a part of it-doesn't need separete form.But If you will marry in the Philippines then you'll file I-129F ONLY for your wife and I-130 for your wife and one each for the 2 kids...it'll be a K3 and K4 classifications or you could do CR1 if willing to wait longer. I had a k1 petition with my 2 kids 5yrs ago(unfortunately things didn't work out-but the petition were granted)Now were here in the US as K3 and K4.
