Did anyone else file a K1 immediately after their divorce was final? If so, anyone get the pink and have no issues with this? I am stressing that I filed the k1 for my fiancee 1 month after my divorce was final. Today has me all stressed out, but I am not sure why. :wacko: Argh, I hate this waiting!!! Thanks

It could be one day after your divorce is final, as long as you are legally free to marry at the time of filing you are ok.

August 27, 2008 - Interview

September 08,2008 - Document Verification request sent to NSO

Spetember 19,2008 - Document Verification done -sent back to US Embassy Manila

November 03, 2008 - Case under review

November 26, 2008 - VISA printed

November 28, 2008 - VISA in transit

December 02, 2008- VISA IN HAND

January 12, 2009 - Arrived USA, POE Los Angeles

January 21, 2009 - Got married

January 22, 2009 - Applied for SSN

March 21, 2009 - SSN card arrived in the mail

April 6, 2009 - took driver's license exam and passed! (written and road test)

April 10, 2009 - Repeat Biometrics Appointment

April 14,2009 - Received AP documents in the mail

April 16, 2009 - Received EAD in the mail

SEptember 4, 2009 - GREENCARD received

We did the same thing. Two weeks after I got the final decree, our package was in the mail. I looked around the forums first, but it seems a lot of people have been in the same situation and everything turned out fine. Hoping for the best for both of us. Good luck, but I'm not worried. :)

While this advice may be 100% correct for many of us, HCMC is a very difficult post to begin with and anything that sends up a red flag, such as a recent divorce, will be scrutinized by a CO there much more than it would be at most other posts.

OP....it's important for you to save every correspondence, receipt, itinterary, photos...etc... and be sure to bring all the evidence you can to support a bona-fide relationship for the interview. You will probably be best served visiting the Regional section of VJ and asking all the other folks who have had to deal with HCMC for advice in regards to the process there.

just for the record... I sent the I-129f petition to uscis the very day I could finally get my hands on the decree...even drove 30 miles to the courthouse and had them type up a copy as it had just become final and wasn't even in the system yet. :whistle: ...in all fairness, I had to wait years to get it.

I think the majority understand that a marriage can be well over long before the paperwork is done.

A recent divorce is one issue among many that will be evaluated. In and of itself it's not a reason to deny a case and it will certainly be no problem at all until the case gets to HCMC. At that point, a recent divorce becomes a potential red flag as to a bona fide relationship but if it's the only red flag, it wouldn't mean much. Nobody here can tell you, "You'll be fine." with any confidence. The Consular Officer will make a decision based on the totality of circumstances they see.
