Student Sues Over Facebook Suspension

(Newser) – With the help of the ACLU, a Florida high school grad is suing a former principal for violating her constitutional rights in suspending her for “cyber-bullying” a teacher, the Miami Herald reports. Katherine Evans created a Facebook page railing against her “worst teacher,” and asked classmates to contribute “feelings of hatred.” None did, and Evans took down the post, but she was still suspended.

The ACLU brought the First Amendment suit forward, charging the principal with violating Evans’ right to “free and unfettered exchange of ideas and opinions in the public arena.” Though she graduated and is now in college, the teen—who also claims she was removed from advanced coursework after the incident—seeks to have the suspension removed from her academic record.

Seriously? What is wrong with that girl. If you are still in HS and it could effect getting into college etc. then I could understand, but it's all in the past. She's in college, she should be focusing on doing well and not getting suspended from there too :)

Most high schools have some type of behavior expectation, which includes NOT engaging in cyber-bullying....

I dunno...I think the school overstepped its authority. She doesn't seemed to have threatened the teacher, and she wasn't doing it on school property, where she very definitely would have been suspended. She also doesn't seem to be suing for billions of dollars, only to have the suspension removed from her record. I say good for her, I hope she wins.
