I-864, Affidavit of Support

Timeline

I'm trying to fill out the I-864 Affidavit of Support that will be sent along with my wife's I-485 Permanent Residence (I just brought her here on a K-1 and we were just married). I'm totally cool with the entire form EXECEPT for Part 1 (a-f)! The instructions don't seem to have an answer for me as to which letter I use:

She is my wife, brought to the US on a K-1.

Option "a" is out - We are not required to fill out an I-130, I-600, I-600A

"b" is out - not filing a I-140

"c" is out - no ownership or interest

"d" is out - I am not a "joint" sponsor. I meet the income requirements for my wife. A "joint sponsor" as I understand it is someone who can substitute for a family member (i.e. me) who can not meet the income requirements.

"f" is out - I am not dead.

INS could not and would not answer my questions as to which box to fill in.

Please give me advice.

As I understood from your choices, you said "a" is out. If you are the petitioner of your wife, you should check letter 'a'. Not "a" is out. Letter "A" is correct. Letter "A" is referring to you "a petioner of your wife"

Your fiance/e came to the US on a K-1, you got married, they are now your relative and you are sponsoring them. A is the right choice :thumbs:

Thank you for your replies.

If you just read the form itself, "a" seems logical, but if you read the instructions, it seems that you would only fill in "a" if you were also filing an I-130, I-600 or I-600A.
