should have done it before you got married. Now that you are married, you will need the EAD.

Negitive. :no:

A K-1 can get SSN within 76 days of entry, after that they will need EAD or Green-card.

We applied for SSA shortly after marriage using married name.

K-1 does not loose its "Work auth" status because of marriage, they are still K-1.

Some MORRONS at SSA will try to pull the "Now that you are married you are K-3" stunt, show me where we filed an I-130 to qualify for a K-3???

Two options.

Go to another SSA office perhaps in a bigger city, OR apply using Maiden name, and worry about name change with SSA later after getting the Green-card.

still aint goon get this person a SSN......

besides....why do you need a SSN for anyway at this point....you wont get a (K-1) EAD in time to work.....just get the EAD based on AOS filing and get it in any name that you want......just go with the flow.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Just for the record... we were already married when Russell applied for his SS# too. They knew this because I applied for a new card with my new last name at the same time.

My guess is, like every other organization in this process, they are just uninformed/uneducated to the proper interpretation of the laws.

please explain then why 100's of people are successful getting SSN after marriage but before 14 days before the I-94 expired? Please explain that to my wife? Did she get her SSN incorrectly?

Many reason to get SSN (particulrlay this time of yeat)... soon to be tax filing, bank accounts, pension benneficiary, etc......

This is from the social security website: http://ssa-custhelp.ssa.gov/cgi-bin/ssa.cf...php?p_faqid=576

My immigration document shows K-1. How do I get a work Social Security number?

Question

The K-1 symbol indicates you are the fiancé of a U.S. citizen. As such, you are eligible for a Social Security number and for employment.

To apply for a Social Security number:

* Complete an Application For A Social Security Card (Form SS-5); and

* Show us documents proving:

*

o Immigration status;

o Work eligibility;

o Age; and

o Identity.

* Take your application and original documents to your local Social Security office. If you live in the New York City metropolitan area, Las Vegas NV, Orlando FL, or Phoenix AZ you may need to apply in person at your local Social Security Card Center.

----------- The thing that they got stuck on this morning is - Work Eligibility -- but if I'm not mistaken, form RM00203.500 is proof of eligibility to work without specific DHS authorization?

Missing someone gets easier everyday because even though you are one day further from the last time you saw them, you are one day closer to the next time you will.

True, K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

However, it is handy for dealing with other MORONS when adding the spouse to Medical Insurance, bank accounts, etc..

I'm not about to explain anything to anyone as I have never looked at the regs.

If you wish, you go down there and take copies of all the regs and you tell them how right you are....after wasting your time, you will decide like I did and just go along with the program and save the frustration.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Marriage laws are State specific. :)

The SSA should really all be on the same page with this and educate their employees accordingly.

I tend to agree with you Gaura in that i'd just find a bigger office but you shouldn't have to because someone else got it wrong.

good luck sweetie!

i know Tennessee requires you to get the ssn before you can get a marriage license.

ID and Residency Requirements:

You will need a valid driver's license or certified birth certificate or valid passport to get married in Tennessee.

You must also provide your Social Security number. It is a non-negotiable requirement. You must have proof of Social Security. Passports from those who are not US citizens are acceptable.

You do not have to be a resident of Tennessee.

YMMV

OP,

At this point your options are (1) try another office (2) wait until you get your green card or EAD. You will have to update your records with SSA once you have a green card anyway (your status will change from K1 to LPR) so you can change your card to your married name at that point too. You really just need your SSN for employment. Yes, I know a SSN is needed for setting up bank accounts etc.. But it will take 3 months to process the EAD, you could get by with cash or credit if you can't find someone at the SSA to process your card.
