Steps after I130 approval...

Hello Dear friends and everyone..............

I know very well that like me many people are confused that,what to do after I130 approval....hope this will guide you at least little bit..

Important Note: Do not make hurry or rush or take your own decision. wait for NVC letter.Reason is only that, case to case requirement of document etc will change.So,better wait for proper instruction, and if you have already lawyer then no problem

1. After approval you (petitioner) will received hard copy of approval letter.

2. applicant (beneficiary) out side the USA also will get letter from NVC and packet of form in which you have to fill up your detail and fill up detail of Agent who will communicate with NVC for future reference. Agent will be a your relative in USA or your petitioner or yourself too.

3. same time petetioner in USA also receive same copy of form and bill of process, that he/she has to submit in NVC and take fee receipt.

4. after that NVC will send other form for affidavit of support, which petitioner has to submit in NVC with financial detail that you are capable to take responsibility of beneficiary who will come to USA.

5. NVC will send other form to beneficiary in his/her country and list of documents tht one has to arranged like birth certificate ,police certificate ,etc,etc. and filled form has to be submit at local embassy with documents as per instruction.(in some country local embassy/consulate ask to submit original document which will be returned at the time of interview)

6. after submitting all this, in few days local embassy will send you interview schedule.

7. complete Medical examination and then, go for interview at given time and place...

.........Rest of ths thing is hand of GOD.

Oh my goodness!!!! This is what I've been trying to find out for the longest, the complete step by step of the whole process.... If I knew you I would kiss your feet ( just kidding). This info helped alot!!!! Thanks!!!!

when choosing the AGENT - is it better to choose USC? i am asking because my hubby has very stressful job and is kinda messy and I would rather chose me instead - just to make sure everything is done!!! what do you think guys???

Hello,

My I-130 petition was approved on September 3, 1008. And per the approval notice from USCIS the petition was also mailed the same day to the NVC. NVC said they need up to 90 days to receive the package. its now been over 90 days since the package and now they still have not received it. They say call USCIS, USCIS says that they have done their part and to contact NVC. So now, niether of the departments have my petition, and I am not sure who to seek help from.....any suggestions?

I choose my self(beneficiary) as the AGENT since my husband will stay in my place for a couple of months.

I e mailed my DS-3032 but did not hear anything from NVC yet....hopefully will hear from NVC soon :yes:

Hi Pter, thank you for the information you shared here. But I still have some questions about having a lawyer. Unfortunately, our lawyer is not giving us an up to date instructions on what will happen next with regards to our case. We I've received emails from USCIS informing us that our I-129 and I-130 have been approved and mailed us the notice of approval. But since we hired a lawyer to take care of things, would this mean he'll be the one to receive that mail or would my husband and I still receive that hard copy? How long does it usually take for that hard copy the recipient? Am asking coz my husband is coming to our country in four days for the holidays. So we would like to know if that won't affect anything with regards to our case.

have you appoint lawyer already when you applied for I130 ?? if ,yes then i think he has kept his(lawyer) address for mail communication. Other wise approval notice first come to petitioner. well, you can contact the service center from where you or your husband has filled I130 (may be California or Vermont,pls varify with your husband).

after approval there are few forms,which will be send by NVC to you and your husband, where you have to mention the name of choice of agent etc...well,that is post process but first ask your lawyer to show you approval notice..i am sure there are some other instruction also with that.

Yes, if you have a lawyer on your case, the NVC mailings will all go to them. I had actually decided to remove my lawyer from our case, and requested USCIS to change the information but apparently they only did this for the I-129F. So the NVC by default will be sending mailings to my former lawyer. I have requested that they remove the former lawyer and send all mailings to me so we'll see how that goes. So in a nutshell, your lawyers gets everything if they're on your case.

Sankuniku, can you please tell me how you went about removing your lawyer, we are experiencing problems with ours and would like to remove him but do not know how. NVC sent him the fee bills a month ago and as of yet he has still not done anything about them and refuses to reliece thispaper work to us. This is what happens when you have to pay people up front you get ###### service grrrrr sorry im really angry this process is stressfull and takes a very long time without a Lawyer making it even worse
