I emailed HMRC today and informed them that I am now living in the US and enquired about a tax rebate. Thought it might be helpful to others who haven't dealt with this yet.

This is the response I got:

Your repayment claim upon leaving the UK, and any follow up enquiries, must be

dealt with by the tax office responsible for your UK tax affairs. The Centre for

Non-Residents do not deal with claims of this type, it is usually the tax office

responsible for the payroll of your last UK employer.

The claim will be considered once your tax office has received a completed form

P85, along with parts 2 & 3 of your P45. Form P85, and further information is on

our website at http://www.hmrc.gov.uk/cnr/p85_p85s.htm

The P85 relates to the tax year of departure (6th April - 5th April) from the

UK. If you think that you have paid too much tax for the previous year, ask your

tax office to consider any refund for that year too.

You may find leaflet P3 (2003) concerning our PAYE system of interest. This is

available on our website at http://www.hmrc.gov.uk/leaflets/c1.htm

You can also find details of tax rates and personal allowances on this page.

Please forward your P85 to:-

Centre 1 Area

Queensway House

East Kilbride

Tel: 0845 070 3703

If you cannot call an 0845 number, you can call HM Revenue & Customs from abroad

on +44 161 931 9070. This is a general helpline number but someone can put you

through to your own Tax Office, if necessary.

We are all entitled to it if we worked in the tax year before we left.....but do not hold your breath fellow Brits.

I sent in form P85 as soon as I finished work last September, then I emigrated mid-October. I waited and heard nothing until December, so I called the Inland Revenue.

They said 'oh we need your 2004/05 tax return before we can process it, so the end of January 06 that went to them. Come the end of March I still not heard a thing, so I call the IR again!

'Oh we need your 2005/06 tax retrun done before we can process any refund'

Well of course to do that I had to wait for my old company to issue my P11D at the end of the UK tax year, I got that 2 weeks ago. I now have to send off my P11D and final P45 (note you do not get a P60 if you are not working at the end of the tax year) to my old accountant. They will then submit my final tax return and maybe about 1 year after I left the UK, I may finally get a refund!!!

All I have to say is the Inland Revenue are happy to take it but not so quick to give it back (and you can bet I won't get any interest for all the time passed on my refund).

I think they are w#nkers

That is really weird. I finished working in August 2004 completed the P85 sent in P45 with it, and the rebate was paid into my bank direct within a month.
