Hi

So I'm about to start the whole Fiance visa process and I'm really scared and worried. Some people have told me the fiance visa should be my last option, that it takes so long and sometimes you don't even get it approved, is that true? I also want to know if I really need to have an attorney to help me with the whole process and paperwork or if it is not really necessary.

Fiance visas are one of the easiest by far. Not much paperwork at all. I suggest making multiple trips to help show a bona fide relationship. That's one of the main reasons for being denied.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Before we applied, I called around and spoke with 5-6 lawyers, all whom said the K-1 (fiance) visa is the fastest route. I think people here will tell you they are about they same (correct me if I'm wrong, as soon as we applied I stopped learning and know little about the k-3 (spouse)). If you are still unsure, I would call around and talk to some lawyers, there are some that will give you a free consultation, or at least tell you their opinion (and make you talk to lawyers who have dealt with cases from Venezuela). As soon as we applied for the K-1 it seemed like peoples' favorite thing to do was to tell us about all the 'supposed' really fast K-3 that had gotten approved from Nicaragua.... I dont really believe that they knew what they were talking about...just do your research!

You definitely don't need a lawyer, the paperwork is simple enough and any questions people here are great about answering. It's really a personal decision; whatever you feel most comfortable with/can afford ;) .

Do some research for yourself and come to your own conclusion.

Have a look at all the forms required for K1 visa, see if you feel you can complete them without the use of a lawyer then make your descision.

Timeline

The K-1 Visa Guide includes a checklist which you simply go down and gather each document as you go.

The flowchart will help you understand the process step by step.

The tips will answer some questions and the FAQ will be an invaluable tool as well.

If you have a question, first do a search of the forums to find your answer. If you can not find it then post and ask.

It's against TOS to tell you not to use a lawyer, so I wont say that. ;) But, if you case is straightfoward...meaning no overstays, criminal background...need for waivers...etc. Then you can surely do it by yourself... with the help of VJ. ;)

If you decide to submit the I-129F petition, be sure to include ample (not too much, not too little) "proof of relationship" materials in the petition package. Doing so is normally not necessary, but South American consulates have been acting squirrelly from time to time and may refuse to accept "relationship proof" evidence at the time of the consular visa interview. Also, although the consular interview would be months away, resolve NOW to ATTEND IT IN PERSON with your fiancee, or at least to be around on the consular premises while she is being interviewed. Your presence can eliminate a great number of potentially negative occurrences. Again, this is in the future, but remember it.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
