Hello, my fiancee and i are worried about something. We sent our papers(the petition) to california office on July and they're not accepted yet but last week we were talking about that we want to wait a couple of years more to move out. Im from Perù and he is from Cleveland, Ohio. He is 21 and im 19, he is just concerned about that he doesnt have a place to live and its gona be kind of difficult for me. i want to know whether is a bad idea just to tell these people who are encharged of doing the papers that we've decided to wait a liltte bit longer or not. Im just scared that if i want to apply in 5 years , they are gona to deny the papers . Can anybody give a suggestion? or does anybody heard before about this? ...[/font]

Thanks!

If your fiance withdraws the petition now and gives a brief explanation that you've decided to wait a couple years, I wouldn't expect a problem when you file again. You will lose the filing fee and pay whatever the new one happens to be when you file again.

As has already been mentioned, once the visa is issued, it must be used within six months. So based on your current schedule you would need to plan to move to the US about a year from now.

you should cancel your K-1 and go a different route because the validly is only 6 months.

Thanks for replying.

It means that once you have the K1 visa, you have 6 months to enter the US from the visa issue date and once in the US you have 90 days within which to get married to the petitioner or go back.

I think if you have decided to wait for a few yrs, just write to the USCIS and cancel your petition stating the reason (no need to go into details) and you should be ok when you file at the right time. Right now you will lose the fee and thats about it.
