Hello everyone! How are you guyz? I have a question regarding the validity of use sa K-3 visa ko. I received it last Nov.7. Wala ba syang deadline kong kailan dapat gamitin? Kasi pupunta dito husband ko middle sa Feb. para mag attend sa wedding ng sister ko. So, bale magkasama na kami pabalik sa US. Okay lang ba yun? I am holding a K-3 visa. So, bale 3 months muna bago ko sya gagamitin.

Why don't you try to look for the expiration date in your visa? I think usually 6 months. Just try to check on your visa dear. It's right over there!

ang validity dito sa visa ko is 2 years. Ang concern ko is wala bang deadline ang pag gamit nito kasi 4 months pa before ako aalis for US.

you may want to consider the time you had your medical exam. it is valid for only 6 months. i am not on k3 visa but i have a note stick on the cover page of my passport that i shall contact USEM if i wont be able to leave before the deadline of my med exam Edited by nbfsb

If the medical exam's validity is 6 months and it had lapsed before she files AOS here in the US, she will have to do it all over again with USCIS designated doctor.

My K3 visa has no stipulation or whatsoever about my medical so I am thinking that I can travel anytime I want within that 2 year period. K3 visa does not need to apply Advance Parole even if AOS has not been filed because of that 2-year validity.

Anyway to answer the OP's question, yes she can still use her visa after 4 months.

I was thinking, I understand that a K3 Visa holder is a 2 year multiple re-entry permit. I wanna ask the OP what does it says for your expiration date? Because I'm thinking that may be the validity of your visa. I think that is. If its says there 2 years then nothing to worry. If it says there 6 months then nothing to worry either because you will be leaving on the 3rd month anyway.

For K1 validity of the visa is 6 months but the moment you enter the US the validity will only be 90 days.

Does it applies to K3? when is the 2 year starts? The moment he/she receive the visa or the moment he/she enter the US? just a thought..if anyone could clarify this that would be good.

K3 visa validity is 2 years...there will be no problem if you are planning to use that on Febuary...and also what ive known medical is valid for 1 year...

K-3 Visa

The 2 years is indicated in the US visa that is printed in the passport. Mine says "Issue Date 02/11/08 Expiration Date 02/06/10". The 90 days does not apply to K3 because its for couples who got married in the Philippines. It only applies to K1 who needs to get married within 90 days once they arrived in the US.

Thank you guyz for your answers to my query. The expiration date of my visa is Nov. 2010. So, bale 2 years talaga sya. Since valid lang pala for 6 months ang medical, so safe ako kasi I'll be leaving before the 6th month.

the K3 is valid for 2 yrs from the date of issuance (the i94 should also be dated for 2 yrs as well on this type of visa) it is a multiple entry visa UNTIL you file for adjustment of status.

ONCE YOU FILE FOR ADJUSTMENT of status the k3 visa is no longer valid for multiple entry and you can be tagged for abandoment of petition and refused re-entry if you leave the country after adjustment of status petition has been submitted. always apply for advance parole after the petition is put in. I wanted to go to Mexico with my wife when she was on a k3 visa but we already did her petition and we asked the immigration at the border entry point about this situation they said since she is on AOS processing if she leaves the country now with that visa she might not make it back into the country. good luck

GUYS, BELOW IS FROM THE ADVANCE PAROLE INSTRUCTIONS. FROM MY UNDERSTANDING, U DONT NEED AP IF U ARE K3 AND HAS FILED FOR AOS. SO IF U HAVE NOT FILED AOS THEN U HAVE TO HAVE AP BEFORE GOING OUT OF THE COUNTRY? IS THAT RIGHT?

NOTE: If you are in the United States and wish to travel abroad, you do not need to apply for advance parole if both conditions described below in A and B are met:

A. You are in one of the following nonimmigrant categories:

1. An H-1, temporary worker, or H-4, spouse, or child of an H-1; or

2. An L-1, intracompany transferee, or L-2, spouse or child of an L-1; or

****3. A K-3, spouse, or K-4, child of a U.S. citizen; or

4. A V-2, spouse, or V-3, child of a lawful permanent resident; and

***B. A Form I-485, Application to Register Permanent Residence or Adjust Status, was filed on your behalf and is pending with USCIS.

However, upon returning to the United States, you must present your valid H, L, K, or V nonimmigrant visa and continue to remain eligible for that status.

10/28/08: i went to my husband's interview (pink slip) but more requirements needed from NSO a repeat of CENMAR and MC, marriage index w/ CDLI

11/4/08: husband hand delivered additional docs to USEM; waiting for consul to review it

11/14: consul reviewed docs

11/19: i received letter from Senator stating that husband's Visa approved.

11/20: visa released to delbros

11/24/08: visa in hand

11/26/08:husband flew to Georgia

working permit

12/1/08: sent via USPS to VSC

12/8/08: NOA 1

1/22/09: approved

1/28/09: received EAD card

7/13/09:AOS package sent via USPS

medical exam is valid for 6 months. the embassy placed a note on my passport that if i havent left the PI beofre my medical exam expires (6th montH) i should infrom them asap. i had my medical 1 month before of my scheduled interview.
