So we've been waiting 5 months for some action on Carina's I-751 and today we get a letter in the mail from USCIS stating they want Marina (K-1) to sign as "spouse", and for me to also complete section 4 of the form and sign as USC-also in the "spouse" section. They were nice enough to include page 2 of the original petition we sent in with Section 4 and "signature of spouse" highlighted. Gee, thanks.

Actually the RFE instructions were not as clear as above but like anything with USCIS you have to read between the lines and hope for the best.

On the original submission we completed the form the best we could considering there is no contingency instructions for filing for ROC as a K2, although they require the child files separately when their AOS is approved over 90 days past the K1 AOS approval.

Anyway, I modified page 2 of Carina's petition we have saved to the computer and replaced Marina's info in section 4 with my information and then I printed it out and both Carina and I signed it.

I will attach the 2 pages to the RFE with a note writen on it that we have completed section 4 of the 2nd form since there is no room for a 2nd person's information on the first form, and signed both forms as requested. We will send it off and see if Carina gets her 10 year GC before she gets her US passport. I know we probably don't need the card at this point but I don't want any problems with an "abandoned" petition, and also would like to actually touch the card we paid $500 or whatever for.

Immigration, you gotta love them.

Hello Marina, Carina and Dave:

My son followed me after 8 months, his conditional card was granted after mine. Well, we just sent my son's I-751 and reviewing your post I guess we did it wrong regarding the signatures: "the spouse or parent whom you gained the conditional residence".

Part 4. My name and info (im k1)

Part 6. Only had my son signing. (blank-spouse)

part 7. Again my signature.

We also included a letter explaining the basis for my son's I-751.
