Hey everyone, I am way ahead on getting my paperwork together and my employer is refusing to write a simple to whom it may concern letter  . My regional manager spoke to HR and they are claiming they need a form to fill in or exactly what they need to write, and of course a letter from me allowing them permission to release information.

Has anyone else had this problem if so PLEASE HELP .....

Its not all that uncommon for companies (especially larger ones) to not be able to/willing-to do this. You'll just have to supply pay stubs (and if you've worked there a while, tax returns).

You really only need a copy of your tax transcripts from the IRS. They can fax to you and you can send or fax to your spouse oversea. If you send anything else, they will have to be in original copies. Even your tax returns must be signed and original and includes all orginal w2 forms, etc... Yet, a tax transcript will be accepted without all the hassle.

I didn't want to hassle with all the orginal copies to prove income, so I called the IRS and had them fax me a copy while living oversea. That's what they did. The tax transcript was missing page numbers and yet was accepted without a problem.

No need for employer letter unless you have no tax transcripts or returns filed. That's been my experience.

**** filed K3/CR1 concurrently. My wife and I both work/live overseas. The following timeline continues from the approval of the K3 VISA.

Thanks for the fast responses. I already have the tax things together. I just wanted to have everything they could possibly want so I won’t be scrambling to do it later. From the looks of it the letter doesn’t make much difference. i dont feel so  now

Do add a few recent pay stubs if you have them.

I agree with the others...but if it makes you feel better prepared....see if you can avoid involving HR as they make things so complex and full of red tape (sorry to all the HR colleagues). My company has a 800 # to verify employment...yeah right like the consulate could even call an 800 #. I got my hands on some company letter head, wrote a letter, just had my boss sign and had the admin notarize it. See if your immediate boss can write you a simple letter or better yet you write it and they just sign it...on company letterhead the better. Very simple they can write: XXX is employed as a xxxx since xxxx with xyz inc. The are a permanent full time employee and their yearly salary is xxx.xx plus benefits.

you get the idea.... then find out what type of release form they need from you.

:) good luck!

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!
