Hi all,

I have been reading on this forum since I submitted an I-129F (Fiance) petition in May 2008 to CSC.

Until now everything went well the Petition was approved (with NO RFE) on 10-10-08.

The approval notice indicated the NVC should receive and forward the petition to the Embassy in 2 to 4 weeks.

(I have been told that is all they do for a Fiance Visa.)

As of today 12/8/08 the NVC says they still have not received the approved petition and nothing can be done until 90 days have passed.

I have called several times and told the same thing.

I have followed up with the USCIS, and finally was instucted by the Service Center to send a written inquiry to CSC which I did by express mail on 12/2.

I received a reply today referring me back to the USCIC Service Center, I called again them again today and they did start a service request but indicated it takes 30 days for a response.

I also tried emailing a copy of the petiton and approval to the NVC via there email link as of today no reply.

I am going crazy. I need to know what else to try, who to talk to to help find our missing approval, also if anyone knows the process if after the 90 day wait the NVC still doesn't have the paperwork.

When I received the approval from the USCIS we opened a provisonal file at the embassey and everything is done there except the interview.

Any help or suggestions is greatly appreciated.

I'm not entirely sure what to tell you but I will say that this is often a little too common with CSC.

Do a search here of case still not at NVC or something to that effect and hopefully you'll find all the posts from others who have had the same problems.

Stay on top of USCIS. Call often and, if you do happen to get an actual human, ask to speak to supervisors/managers...someone else.. until you get an answer.

hi, i have the same problem , i received the approval letter for i-730 petition on 10/23/2008 !! and till now the nvc didn't receive it. i called the uscis several times .. every time they tell me a different thing, the last time called, i spoke to a very rude lady.. she told me stop calling.. you have to follow the instructions and wait 90 days!

well i'm so confused now and i don't know what to do.. i think the petition is just lying on one of the uscis desks..and i'm just waiting and can not do anything.

See my timeline.

We had the same. We where in "extra" security checks at CSC. Than got another approval and NOA2.

Best of luck trying to find an answer. We called everyday.

At NVC now waiting for more "extra" checks.

If this helps anyone I have a little more hope but not the good news I have been hoping for.

Contaced NVC again today (up until now they say wait 90 days before they will do anything)

Today they instructed me to send a copy of the I-797C approval and once received they would try to locate the original.

They told me it could take 30 days to get a response. If it is not found I would have to reapply with USCIS. F8#$&*

Not totally happy but sending this by express mail today.

I also contacted my Senator who has an "Immigration Caseworker". :thumbs:

I explained my situation and they indicated they have seen this before and are willing to help.

I had to submit a privacy release form to them.

They also outlined a couple of possible scenarios:

1. The file was sent to Records Divison instead of NVC processing and is considered completed and filed away.

2. USCIS never mailed it.

3. Truly lost by USPS.

In any event they will open an Inquiry (they cautioned they still may have to wait the full NVC 90 day time frame).

In the first two scenarios once located it should be easy to get back on track.

In the event the petition was lost by USPS the process involves USCIS generating copies and My Fiance and I resubmitting "original signatures" on the petiton. Not ideal but much better than the many different answers I received from Customer Service at both USCIS and NVC indicating that we would have to file from step one and start the process again.

At least now I feel like I got a good answer and some asssistance in locating the wayward petiton.

I will keep you advised.

I leave for a visit with my Fiance in 8 days through the New Year, :yes:

I guess the hope of being able to make travel plans for "OUR" return is on hold.

Here it is March 24th 2009. I hope this might help someone else through all this.

We filed for a I129F Fiance Visa Petition in May 2008.

It was approved at CSC on Oct. 10 2008 and was supposedly sent to NVC.

It quickly became apparent that it was lost numerous calls to NVC and CSC proved fruitless.

USCIS Customer Service is pathetic I got several bad answers and was hung up on and told DONT CALL BACK its not our problem.

In Dec. 2008 I contacted my US Senators office and they had a person who works immigration issues, she tried to calm me and felt certain this could be resolved quickly.

We were expecting my fiance to be through the interview and here in the US after the new year surprise not happening.

The package from CSC to NVC was not considered LOST until 120 days from the date on the approval.

After 120 days thye Senators office was required to get written proof the package was not received at NVC or the Consulate.

Finally we were authorized to resubmit copies of all original paperwork, but they wanted ACTUAL SIGNATURES (fortunately I had my fiance do this on my last visit over Christmas fearing this may be the case) we also had to have new passport style photos.

The CSC did reconstruct and in an expeditious manner approved the petition again within 3 weeks and FED-EX the package to NVC.

I know it was delivered on 3/19 but as of today it has not been processed in.....fingers are crossed.

Anyway just wanted to share this if it helps others who have their paperwork lost in transit....

KEEP COPIES

HAVE EXTRA COPIES WITH ORIGINAL SIGNATURES

BE PREPARED TO WAIT OUT THE PROCESS USCIS Does not seem to be flexible with this at all..

BY the way my impression from the Senators aide was that this was not how things were handled in the past so maybe there has been a policy change or something but so so frustrating to be caught up in the red tape.
