I have a feeling he knew full well what he was doing and was just too lazy to fix it thinking he was somehow okay because he was Canadian and/or because he was married to a USC.

He allowed his work visa to expire 7 years ago. Now he's trying to make a sob story as if he can't make the same life for himself in Canada. I love how they try to tug at the heartstrings by saying: "He played Santa at his daughters school for all the kids..."

Hey kids Santa is getting his fat ### hauled back to the North Pole. :D

It doesn't take a genius to figure out that there are rules to follow when it comes to immigration.

LMFAO!!!!!!!!

It does suck for his family, but he knew plain as day what he was doing. It now is time to pass the blame being as he has been caught.

I have empathy for their children. With all the news about illegal aliens and those out of staus that appear almost daily on the news within the USA, both him and his wife were stuck with their heads in the sand regarding his status in the States.

That's a good point.. New Haven is a town that is considered a "refuge" for people who have no status. The city has issued ID cards to many who have no legal status, in the face of the Feds saying not to. ICE has responded in turn. :wacko:

No sympathy here, either. Suck it up, follow the law...what's up with all of the random US citizens who think it's a sob story requiring a "Christmas Miracle" for a Canadian to be illegal but would chuck a Hispanic person over the fence even if they were born here!

It's not that bad; the ID cards don't keep anyone from being deported, and it's a crime-reduction on the part of the city of New Haven. No bank accounts (because no ID) means immigrants carry more cash, which means more street crime and burglaries. I can't really fault the city because it's not like it has the power to deport people.

That is a great point that I never really thought about. Makes perfect sense to atleast cut down on some crime.

I haven't been here in a while, but reading this I must say...

No sympathy for him. Ignorance kills doesn't it? Yeah is a IT guy, he should know better a research a little more before taking advice from a dumba$$ and then come cry around about it. I feel sorry for the kids having to go through this, but he's the only one responsible for putting his family in this situation. Did he not know he was Illegal ?

Plus, IT companies in the US are chockablock with Canadians on work visas. They all know the drill. I can't believe that no one said, when he married his wife, "oh, you can file for AOS now and be free of renewing your work visa every year." And even if he did, as his sister states in her comment, renew his visa every year, he obviously did not advise his new employer of his status and was hoping to slip through the cracks. Everyone on a work visa knows they can be rescinded anyways. I cannot believe he was happy living this way with no real permanent status in the US while supporting a family.

Feb 11 2008 - Package arrives in Chicago

Feb 19 2008 - Receive NOA 1 for everything except I-485. NOA date Feb 15th

There is NO WAY he didn't know what he was doing was illegal. When he got the first visa he would have been made well aware at the POE that it expires in one year and he'd have to either get a new one, or leave the country. He chose to ignore that fact, now he's paying the consequences. Fricken idiot gives Canadians a bad name :P And boo hoo for his wife who will now have to move to a country with universal healthcare to help her with her post-pregnancy health issues whaaaaaaaaaaaaaaaaaaaaaaaa

Yeah the guy really should have at least known the simple things about needing another status after your current one expired (obviously on a TN). It states it right there that you must get another one or leave, period. There is no excuse for that. Him staying on trying to work and bouncing from job to job is totally illegal. He would have to be a complete idiot not to realize that or never bothered to even have a clue what he was working on (status wise).

Now with all that said, the lawyer was right in saying all he has to do is file AOS right now. Stuff like this upon the Green Card interview usually will have amnesty and he should be fine. Still though, maybe he needs to go back to Canada first and get some brains before comming here the next time. People are really stupid.

Here's a story of my old babysitter which is similar. She was here with her husband on a TN and lived in Kansas, he lost his job (should have left the country) and they then applied for a new job in S.C. They moved there, bought a house and put all their stuff in storage until the house was finalized. In the mean time, he worked under the table until his new job came through. They finaly realized he was out of status (TN is only good for the one job you applied for using the TN). Now instead of him trying to go back to the border, apply for a new TN, he decided to wait in S.C., his wife (my old babysitter) decided to visit her parents with the kids over the holidays. So she left the US (real bright when you're already out of status) and then after the visit got screwed at the US border. Out of status, mentioned her husband didn't have a new TN, they found out he was illegally working in the US under the table etc. All said and done, think they got a ban, had to leave all their stuff in storage, lost the house and down payment, the new job and since they couldn't return to get their stuff out of storage, lost all that too as they couldn't pay for the storage costs down there.

As far as I'm concerned that woman - his wife - should be so lucky that Canada accepts her as a resident.

With their attitudes, she might fall through a crack in CDN immigration.
